Musial, Mayor <br />Sept. 5, 2002 <br />Memo: To All of Council <br />From: Mayor Musial K. ` <br />Subject: Motion by Councilperson Kasler to amend Ord. No. 2002-117 to <br />subtract $2,387, the remaining $2,387 from the Housing Council <br />secretary's position, so it remains in the economic development fund, <br />seconded by Gareau Jr. and passed by Council. <br />This amendment by Kasler addresses a matter which doesn't impact the balancing of the <br />budget for 2002 as general fund moneys are not involved. The moneys paid to the <br />secretary of the Housing Council and Tax Incentive Review Council are derived from <br />payment to the City of North Olmsted to the Economic Development Fund, paid by <br />Corporations receiving tax abatement (some $9,500 per year) and at an annual abatement <br />fee. <br />It is noted while reviewing material for this veto that Ord. No. 99-56, part M. of Section 1 <br />has the language "Similarly, the Mayor shall determine the work days and hours worked <br />of the Secretary of the Housing Council and Tax Incentive Review Council." It appears <br />that later "Rates of Compensation Ordinances, i.e. 2001-02 and 2002-59 inadvertently <br />eliminated such language. I must rely on our law Director as to what impact such <br />omission has on the payment of salary to said Secretary. <br />Heretofore, we have treated payments to said Secretary as on a project basis to be paid as <br />a lump sum annually broken up into two payments. Based on prior history, a high <br />percentage of work has already been accomplished and therefore some if not all of the <br />$2,387 in questioned may be encumbered. Time tracked by sa.id secretary totals roughly <br />290 hours for the first three months of 2002. <br />It is suggested tha.t the payrnent goes forward as scheduled and the matter be addressed <br />for next year and I will veto the instant proposed amendment based on this assumption. <br />To move forward with the proposed amendment may possibly subject the City to a civil <br />law suit for moneys earned and knowingly withheld by Council action. <br />I hereby veto the amendment proposed by Councilperson Kasler amending Ord. <br />No. 2002-117 to subtract $2,387, the remaining $2,387 from the Housing Council <br />secretary's position.
