<br /> <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2002-17 <br />BY: Council Members Nashar and Gareau. <br />AN ORDINANCE AMENDING SECTIONS 351.18 AND 353.07 OF THE TRAFFIC <br />CODE IN ORDER TO INCREASE THE FINES FOR CERTAIIV PARKIIVG OFFENSES <br />AND TD AMEND THE PROCED URES FOR COLLECTION OF FINES, AS THRICE <br />AMENDED. <br />WHEREAS, the fines for parking offenses as set forth in Section 351.18 of the Tra.ffic Code <br />were established by Ordinance No. 85-38, adopted on December 17, 1985, and the fines for parking <br />in fire lanes as set forth in Section 353.07 of the Traffic Code were established by Ordinance No. 80- <br />41, adopted on April 15, 1980; and <br />R'HERF.AS, it is the desire of this Council to incre.ase and standardize the fines for all parking <br />and fire lane offenses established in Chapters 351 and 353 of the Traffic Code, including, but not <br />limited to, avernight parking violations, handicapped parking violations, and fire lane vialations, in <br />order to promote traffic safety and protect the rights of handicapped persons; and <br />WHEREAS, it is the desire of this Council to amend the title of the aforesaid Sections and <br />to amend the description of the procedure for issuing parking tickets and the for collecting fines <br />therefrom, sv as to exercise powers of local control in this regard and to more accurately reflect the <br />practices of the Police Department. <br />NOW, THEREFORE, BE IT O.RDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CQUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECIION 1: That Sectian 3 51.18 of the Traffic Code, entitled "Waiver Provisions," which <br />presently reads as follows: <br />"351.18 WAIVER PROVISIONS. <br />(a) Whoever violates any provision of this chapter shall be guilty of a misdemeanor. Any <br />such person who has received notice to appear and to answer to such violation, upon filing personally <br />with the Chief of Police at the City Hall, a written plea of guilty, commonly known as a waiver, within <br />forty-eight hours after such notification, Sundays or holidays excepted, may for such offense pay a <br />fine of six dollars ($6.04) without costs. If such written plea is made after forty-eight hours after such <br />notification, Sundays or holidays excepted, then such violator may pay a fine of ten dollars ($10.00), <br />without costs. <br />(b) Notwithstanding other waiver fees contained herein, any violator of Section 351.13 <br />or 351.14 may sign a waiver and pay for the first offense, fifteen dollars ($15.00), and for each <br />subsequern offense during the same winter season, not less than twenty-five dollars ($25.00). <br />
