.?; ??. ... .. . <br />?'. <br />+ Ordinance 2002-17 <br />Page 2 <br />(c) Notwithstanding other waiver fees contained herein, any vidator of Section 351.20(d) <br />may sign a waiver and pay a fine of twenty-five dollars ($25.00) without costs. <br />(d) Upon fa,ilure of a violator to appear and make such pleas as aforesaid within a <br />seventy-two hour periad, a warrant may be issued for the arrest of the violator and, upon conviction <br />of the offense, such vlolator shall be subject to the penalty provided in Section 303.99 and a11 <br />provisions incorporated herein." <br />shall be amended, and, as amended, shall read in its entirety as follows: <br />"351.18 PARKING TICKET PROCEDURES. <br />(a) Parking tickets shaU be written on a pre-prirned form approved by the Chief of Folice, <br />which shall include all information necessary to identify the motor vehicle in violation and its <br />registered owner. Upon observation of a pazking violation, parking tickets may be issued by any <br />police officer or auxitiary police officer specifically designated by the Chief of Police, and shaU then <br />be securely placed upon the vehicle pazked in violation of this chapter, specifically by placing a copy <br />of the parking ticket beneath the windshield wiper on the driver's side of the vehicle. The registered <br />owner of a motor vehicle ticketed for a parking violation sha11 appear at the North Olmsted Police <br />Departmecit to pay the fine for such pazking violation, in person, through a designated represerrtative, <br />or postmarked by mail, within forty-eight hours after the issuance of su.ch parkmg ticket, Sundays or <br />holidays excepted, and pay a fine of fifteen dollars ($15.00), without costs. If such payment is <br />tendered or postmarked more than forty-ei,ght hours after such issuance, Sundays or holidays <br />excepted, then the fine shaU be increased to twertty-five dollars ($25.00), without costs. Voluntary <br />payment of such fine shaU not be deemed a formal admission of guilt but shaU constitute <br />acknowledgment of the validity of the parking ticket and shaU preclude prosecutivn of the <br />misdemeanor offense alleged therein. <br />(b) Notwithstanding other fees contained herein, any violator of Sections 3 51.20(b)(1) <br />shall pay a fine of fifty dollars ($50.00) without costs. <br />(c) Whoever violates any provision of this cha.pter shall be guilty of a misdemeanor. If a <br />parking ticket is not paid within a seventy-two hour period pursuant to the procedure provided in <br />paragraph (a), then the Police Department shaU issue at least one (1) written commumcation to the <br />registered owner of the motor vehicle that was issued the parking ticket, at the address of registration <br />on record with the Burea.u of Motor Vehicles, and therein advise the registered owner of the unpaid <br />parking ticket. Such written communication shall be forwazded by regular mail and sha11 further <br />advisE that any unpaid parking ticket will be forwarded to the Rocky River Municipal Court, by a date <br />specific, not less than ten (10) days from the date a such correspondence, for further proceedings and <br />prosecution of the parking violation, subject to the imposition of Court costs. Unpaid parking <br />violations may then proceed to Rocky River Municipal Court upon the issuance of a uniform traffic <br />citation and subject to a.tl procedures therein. Such parking violations thereafter shatl be subject to <br />the penalties provided in Section 303.99 and all provisions incorporated herein. <br />SECTIONZ: That Section 353.07 of the Traffic Code, also entitled "Waiver Provisions," <br />which presently reads as follows: <br />353.07 WAIVER PROVISIONS. <br />(a) Whoever violates any pravision of this chapter sha11 be guilty of a misdemeanor. Any <br />such person who has received notice to appear and to answer to such violation, upon filing personally <br />with the Chief of Police at the City Hall, a vvritten plea of guilty, commonly known as a waiver, within <br />forty-eight hours after such notification, Sundays or holidays excepted, may far such offense pay a <br />fine of seven dollars ($7.00) without costs. if such written plea is made after forty-eight hours after <br />such notification, Sundays or holidays excepted, then such violator may pay a fine of twelve dollars <br />($12.00) without costs. <br />2
