<br />Ordinxnce 2002-17 <br />Page 3 <br />(b) Upon failure of a violator to appea,r and make such pleas as a.foresaid within a <br />severny-two hour period, a wanant may be issued for the arrest of the violator and upan conviction <br />of the offense, such violator sha11 be subject to the penalty provided in Section 303.99 and all <br />provisions incorporated herein." <br />sha11 be amended, and, as amended, shall read in its entirety as follows: <br />"353.07 PARHING TICKET PROCEDURES. <br />(a) Pazking tickets shall be written on a prerprixited form approved by the Chief of Police, <br />which shall include all information necessary to identify the motor vehicle in violation and its <br />registered owner. Upon observation af a parking violation, parking tickets may be issued by any <br />police officer or auxiliary police officer specifically designated by the Chief of Police, and shall then <br />be securely placed upon the vehicle parked in violation of this chapter, specificaUy by placing a copy <br />of the parking ticket beneath the windshield wiper on the driver's side of the vehicle. The registered <br />owner of a motor vehicle ticketed for a parking violation shall appear at the North Olmsted Police <br />Departmerrt to pay the fine for such patking violation, in person, through a designated representative, <br />or postmarked by mail, within forty-eight hours after the issuance of such paxking ticket, Sundays or <br />holidays excepted, and pay a fine of fifteen dollars ($15.00), without costs. If such payment is <br />tendered or postmarked more than forty-eight hours after such issuance, Sundays or holidays <br />excepted, then the fine shall be increased to twenty-five dollazs ($25.00), without costs. Voluntary <br />payment of such fine shall not be deemed a formal admission of guilt but shall constitute <br />acknowledgment of the validity of the parking ticket and shall preclude prosecution of the <br />misdemeanor offense alleged therein. <br />(b) Whoever vialates any provision of this chapter sha11 be guilty of a misdemeanor. If a <br />parking ticket is not paid within a seventy-two hour period pursuant to the procedure provided in <br />paragraph (a), then the Police Department sha11 issue at least one (1) written commurrication to the <br />registered owner of the motor vehicle that was issued the parking ticket, at the address of registration <br />on record with the Bureau of Motor Vehicles, and therein advise the registered owner of the unpaid <br />parking ticket. Such written communication shall be forwarded by regular mail and shall further <br />advise that any unpaid parldng ticket will be forwarded to the Rocky River Municipal Court, by a date <br />specific, not less than ten (10) days from the date a such correspondence, for further proceedings and <br />prosecution of the parking violation, subject ta the imposition of Court casts. Unpaid parking <br />violations may then proceed to Rocky River Municipal Court upon the issuance of a uniform tra.ffic <br />citation and subject to a11 procedures therein. Such parking violations thereafter shall be subject to <br />the penalties provided in Sectian 303.99 and a11 provisions incorporated herein." <br />SECTION 3: That any Ordinance, or part of any Ordinance, in conflict or inconsistent with <br />any provision of this Ordinanca is, to the extent of any such conflict or inconsistency, repealed. <br />SECTION 4: That this Ordinance sha11 take effect and be in force from and after the earliest <br />period allowed by law. <br />3 <br />
