<br /> <br />1305.05 BU.tLDING CODE 20 <br />Upon the filing of an appfication for a permit and during the ten day <br />waiting period referred to, the Buiiding Commissioner or his authorized inspector <br />shall make an inspection of the property to be improved and determine ths <br />elevatian and grade requested to be established on the premises involveci will not <br />be injurious to adjoining praperty. Any praperty owner or person wha has reason <br />ta believe that the proposed elevation and grade may be hazardous or injurious by <br />virtue of a proposed change in elevation or grade, or in the construction <br />contemplated by the application for a building permit, may file objections with <br />the Board of Building Got1e Appeals. The Board shall, upon receipt of such <br />protest, notify the applicant and the objector of the date for a hearing before the <br />Bnazd on such objections which shall not be more than two weeks after the filing <br />of such written protest. <br />(b) Lots With 50 Feet or Less FrontUe on an Existing Street,, (Amendec? In the event <br />the application for a building pemut as required under the provisions ofthe <br />Dwelling Code involves the proposed construction or alteratian of any dwelling <br />or appurtenant structure an a lot having fifty feet or less frontage on an existing <br />street, such application sha11, in addition to the provisions of subsection (a) hereof <br />be referred to the Engineering Department who shall determine prior to the <br />approval of the applicatian for a permit for such premises, that the proposed <br />construetion or alteration does not affect drainage of surface water or waste unto <br />ar over adjoining property or into any public street as may be injurious tu the <br />public safety, health or welfare and camplies with the retention requirernents of <br />the Engineering Department. <br />(c) Exposed Exterior Masonry Walls. Exposed exterior walls vf masonry canstruction <br />above grade shall be faced with brick, stone or other material hereafter approved <br />by the Board of Building Cade Appea.ls. <br />(d) Chimneys, Flues and Vents. <br />(1) Alt chimneys, flues and gas vents, that are exterior of the structure and <br />terminate abave the raof Iine causing them to be viewable fram a pubiic <br />way, shall be enclosed in a conasian resistant material that simulates a <br />conventional rnasonry chimney. <br />(2) Tn lieu of above, an enclosure compatibte with exterior architectwal <br />elements of the structure shall enclose the metal chimney, flue or gas vent. <br />(3) Definitians of a chimney, flue or gas vent are as follows: <br />A. "Chimney" means a primarily vertica] masonry or reinforced <br />concrete shaft which encloses one or more flues. <br />B. "Gas vent" means a flue for removing produds of combustion <br />from gas heat appliances. <br />C. "Flue" means a passageway, vertical or nearly so for conveying <br />gaseous products of combustion to the outer air. <br />(Ord. 97-27. Passed 6-17-97.) <br />
