<br />1305.04 DEFINTTIONS AND AMENDMENTS.
<br />(a) Definitions. Wherever titles, words and phrases aze used in portions of the 4ne and Two-
<br />Faxnily Dwelling Code herein adopted, such terms shall be construed to mean the equivalent
<br />officer, word or phrase applicable to the City. "Building Official" as used in such Code, means
<br />the Building Commissioner of the City.
<br />(b) Amendmems. The One and Two-Family Dwelling Code adopted herein is hereby
<br />modified in the manner respectively indicated:
<br />(1) Sec. 103-ScM (Amended.). The provisions of this code apply to the
<br />eonstntction, alteration, repair, use, oecupancy and maintenance of
<br />detached one, two and threerfamily dwellings and their accessory
<br />structures. Height and minimum size nf structures shall be governed by the
<br />Zoning Code of the City of North Olmsted.
<br />(2) Sec. 105 Entrv (Amended). The Building Commissioner ar any of his
<br />designated agents may at any reasonable hour, enter any dwelling,
<br />multifamily dwelling, building, structure or premises within the City to
<br />perform any duty imposed on him by this building cade, provided that
<br />permissiun to enter is obtained from the occupant or, in the case of
<br />unoccupied property, from the owner or his agent. If such permission is
<br />refused or is otherwise unobtainable, a search warrant must be obtained
<br />before such entry or inspection is made, except in the case of an existing
<br />emergency in which case sntry may be made at any time and no search
<br />warrant is necessary. No person shall refuse to pemut such emergency
<br />entry or inspection, nor shali any person hinder, obstruct, resist or abuse
<br />any person making or attempting to make such entry or inspection.
<br />(3) Sec. 106-Viotations and Penalties (Amended). No person, firm or
<br />corporation, whether as owner, lessee, sub-lessee, or accupant shall erect,
<br />construct, enlarge, alter, repair, improve, remove, convert, demolish,
<br />equip, use, occupy or ma.intain any one, two or three-family dwelling in
<br />the City or cause or permit the same to be done, contrary to or in violation
<br />of any provision of this code. Whoever violates any provision of this
<br />chapter or any code adopted herein or fails to comply with any lawful
<br />order issued pursuant thereto is guilty of a misdemeanor of the third
<br />degree. Each day during which noncompliance of a vialation continues
<br />shall constitute a sepazate offense. The City may institute injunction
<br />proceedings in Common Plea.s Court to abate the nuisance of any violation
<br />or failure to cease work after receipt of a stop work order.
<br />(4) Sec, 107-Right of Appeal (Amended). All persons shall have the right to
<br />appeal the Building Commissioner's decision to the Board of Building
<br />Appeals established under Chapter 1315 of Part Thirteen Building Code.
<br />(5) Sec. 111.4ExQiratian eletedl. (Editor's Note: See Section 1321.05 af the
<br />Cvdified Qrdinances).
<br />(6) Sec. 112.1-Plans (Amended). When required by the Building Official,
<br />plans shall be drawn to scale and shall be of sufficient clarity to indicate
<br />the nature and extent of the work proposed and sha11 show in detail that it
<br />will conform to the provisions of this Code and aIl relevant 1aws,
<br />ordinances, rules and regulations. Plans sha11 include a plot plan drawn to
<br />scale showing the location of a1t easements, drainage facilities, adjacent
<br />grades, property tines, the proposed building and of every existing
<br />building on the property. The Bwlding Offcial may require drawmgs to
<br />be verified by a registered architect or engineer as to code compliance.
