<br /> <br />CITY OF NORTH OI.MSTED <br />ORDINANCE NO. 2002 -43 <br />BY: Mayor Musial and Councii Member McKay. <br />AN ORDINANCE AUTHORIZING THE TRANSFER OF THREE (3) <br />STORM SEWER EMPLOYEES FROM THE SERVXCE <br />DEPARTMENT TO THE WASTE WATER TREATMEN7' SEC7`ION <br />OF THE PUBLIC WURK.S DIVISIUIV, AND FURTHER <br />AUTHORIZING THE PAYMENT OF THEIR WAGES FROM THE <br />SEWER REVENUE FU1VD, AND DECLARIIVG AN EMERG.ENCY. <br />WHEREAS, pursuant to authority provided in Article XVIII, Section 3 and <br />Article XVIII, Section 4 of the Ohio Constitution, the City owns and operates a sa,nitary <br />sewer system (the System), which provides sanitary waste-wat+er collection and treatment <br />services for the City and its inhabitams and for certain adjacem areas in the City of <br />Fairview Park and Olmsted Township and the inhabitants of those areas; and <br />N'HEREAS, the City has, over the years as documemed by administration <br />reviews and reports, including the May, 1996, report of City Environmental Engineer <br />Dennis Long, experienced, at times of heavy precipi#ation, significa.nt inflow and <br />infiltration of storm water irno certain sanitary sewer collectian facitities of the System, <br />resulting in an overloading of the System and sanitary wastewater backups, bypasses and <br />overflows; and <br />WHEREAS, such inflows and infiltrations from the storm water sewer system <br />into the sanitary sewer system create potential public nuisances threatening the health and <br />safety of the inhabitan;ts of this community, as well as may constitute violations of state <br />and federal environmental laws; and <br />WHERLAS, as a result of said administration reviews and reports, the City has <br />employed, and continues ta employ, certain bargaining-unit laborers in the Department of <br />Public Service whose duties are to clean, maintain, and keep in good repair, the City's <br />storm water sewer system, including storm wates ditches, sewers and outlets, in order to <br />minimize inflow and infiitration of storm water imo the sanitary sewer collection <br />facilities ofthe System; and <br />WHEREA.S, the wages and benefits of said bargaining-unit laborers have <br />heretofore been paid from the General Revenue Fund; and <br />WHEREAS, an orgattizational review indicates that the duties perforrned by <br />certain bargaining-unit laborers in the Department of Pubtic Service more appropriately <br />fa11 under the Waste Water Treatmetrt Section of the Division of Public Works, a.nd that <br />the wa$es and benefits of said employees holding these bargaining-unit laborer positions <br />should be paid from the Sewer Revenue Fund; and <br />
