<br />WHEREAS, this Council has reviewed ihe Ma.y, 1996, report of City
<br />Environmerrtal Engineer Dennis Long, and has further consuhed with said Environmental
<br />Engineer, and other Administration personnel, regarding the continuing need to clean,
<br />maurtain, and keep in good repair, the City's storm water sewer system, including storm
<br />sewer ditches and outlets, in order to cotrtinue to prevent, or minimize, inflow and
<br />infihration of storm water imo the sanitary sewer collection facilities of the System,
<br />particularly during moderate to heavy precipitation events; and
<br />WHEREAS, this Council concurs with, and specifically finds, that the
<br />employment of said three bargaining-unit laborer positions proposed for transfer, whose
<br />duties are, and will continue to be, to clean, maintain, and keep in good repa.ir, the City's
<br />storm water sewer system, directly furthers the express purposes for which the Sewer
<br />Revenue Fund was estabtished; and
<br />R'HEREAS, this Council fiuther finds that, itt order to continue to provide for the
<br />cleaning, maintaining, and keeping in good repair, of the City's storm water sewer
<br />system, in a fiscally responsible manner, it is necessary that three bazgaining-unit laborer
<br />positions from the Department of Public Service, whose job duties are to clean, maintain,
<br />and keep in good repair, the City's storm water sewer system, be transferred to the Waste
<br />Water Treatmentt Section of the Division of Public Works, and that the wages and
<br />benefits of the employees holding these three positions be paid, upon transfer, from the
<br />Sewer Revenue Fund;
<br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL QF THE CITY
<br />OF N4RTH OLMSTED, CUYAHOGA CUUNTY, AND STATE t)F OHIO:
<br />SECTION l: That this Councit hereby approves and authorizes the follawing
<br />reorganization af the Department of Public Service: Transfer af three bargaining-unit
<br />laborer positions, with duties of cteaning, maintaining, and keeping in good repair, the
<br />City's storm water sewer system, from the Service Department to the Waste Water
<br />Treatment Section of the Division af Public Works.
<br />SECTIUN Z: That, pursuant to and consistent with the City's authority under
<br />applicable general laws and Article XVIII, Section 3 and Article XVIII, Section 4 of the
<br />Ohio Constitution, this Council hereby expressly finds and determines that the work
<br />which the employees holding said bargaining-unit laborer positions are performing, and
<br />will corninue upon transfer to perfonn, directly furthers the express purposes for which
<br />the Sewer R+eveiwe Fund was established, and that therefore the wa$es and benefits of the
<br />said employees holding said laborer positians and transferred to the Waste Water
<br />Treatrnent Section af the Division of Public Works, pursuant to the reorganization
<br />provided for in Section 1 of this Ordinance, may be paid from the Sewer Revenue Fund.
