CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2002 - 51 <br />BY: COUNCIL MEMBERS GAREAU, KASLER, NASHAR, MILLER, MCKAY <br />AN ORDINANCE REPEALING ORDINANCE 97-122 ENTITLED, "AN <br />ORDINANCE CREATIlNG A NEW CRAPTER 133 OF THE ADMINISTRATIVE <br />CODE OF THE CITY OF NORTH OLMSTED, ENTTTLED `INTERIM <br />DIRECTOR APPUINTMENTS,' AND DECLARING AN EMERGENCY," AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, City Council on December 16, 1997 passed Ordinance 97-122, which was <br />vetoed by Mayor Edward Boyle on Decsmber 24, 1997 and which veto was ovemdden by City <br />Council on January 6, 1998; and <br />WHEREAS, the present Chapter 133 of the Codified Ordinances of the City of North <br />Olmsted, as enacted via Ordinance 97-122, creates in the Mayor the authority to remove <br />Directors without the concurrence and consent of two-thirds (2/3) of the members of City <br />Council eligible to vote; and <br />WHEREAS, the Charter of the City of North Olmsted at Art. III, Section 5 staxes, "the <br />Mayor may during his term, without concurrence of Council, remove any officer or employee <br />whom he has appointed provided, however, that heads of departments or divisions crea.ted by this <br />Charter may only be removed with the concurrence of two-thirds (2/3) of the members of <br />Council eligible to vote;" and <br />WHEREAS, the Charter of the City of North Olmsted creates thre+e (3) mayoral- <br />appointed Directors: the Director of Human Resources, the Director of Public Safety and the <br />Director of Public Service; and <br />VVHEREA5, City Council wishes to restore unto itself the full and unambiguous <br />authority to oversee the removal of the Director of Human Resources, the Director of Fublic <br />Safety and the Director of Public Service, as expressly delegated to it by the citizens of North <br />Olmsted in their duly ena.cted Charter; and <br />WHEREAS, the Council further wishes to define and protect the status of the three <br />individuals, Ray Thomas, Lisa Thomas and Don Copeland, who have received interim <br />appointments by the Mayor to serve, respectively, as Director of Public Service, Director of <br />Public Safety and Director of Human Resources; <br />
