<br />Ordinance No. 2002-52 <br />handicapped parking card from the Registrar of Motor Vehicles in accordance with Ohio R.C. <br />4503.44, shall be permitted to park in areas designated for the handicapped as specified in <br />subsection (b) hereof. <br />(d) From and after September l, 1982, any person desiring to develop property for <br />general retaii business purpvses located in a General Retail Business District or a Mixed Use <br />District, requiring more than twenty-five parking spaces as specified in the Zoning Code, shall be <br />required to inciude in their parking layout plan submitted ta the Building Department, <br />handicapped parking spaces, which sha11 be on the formula of <br />Qne handicapped space for every twenty-five parking spaces. <br />Two handicapped spaces for every twenty-six to fifty parking spaces. <br />Three handicapped spaces for every fifty-one to ninety-nine parking spaces. <br />Four handicapped spaces for every 100 to 199 parking spaces. <br />Five handicapped spaces for every 200 to 299 parking spaces. <br />Six handica.pped spaces for every 300 to 399 parking spaces. <br />Seven handicapped spaces for every 400 to 500 parking spaces. <br />One handicapped space for each additional 200 spaces over 500. <br />The establishment of such handicapped spaces, as provided herein, sha11 be a condition for <br />the issuance of an occupancy permit as pravided for in the Building Cade. <br />(e) Any person who violates subsection (c) hereof shall be guilty of a minor <br />misdemeanor, the fine for which is more specifically set oui in this ehapter. Any person charged <br />under subsection (c) hereof shall have an absdute defense if they are, in fact, handicapped as <br />defined by Oluo R.C. 4511.69(H)." <br />shall be amended, and, as amended, sha11 read in its entirety as follows: <br />"351.20 HANDICAPPED PARKINNG. <br />(a) Special parking locations a.nd privileges for persans with disabilities that limit or impair <br />the ability to walk, also known as handicagped parking spaces or disability parking spaces, shall be <br />provided and designated by all political subdivisions and by the state and all agencies and <br />instrumentalities thereof at a11 offices and facilities, where parking is provided, whether owned, <br />rented, or leased, and at all publicly owned parkin$ garages. The locations shall be designated <br />through the posting of an elevated sign, whether permaneirtly affixed or movabte, imprinted with the <br />international syrnbol of access and shall be reasonably close to exits, entrances, elevators, and raznps. <br />A11 elevated signs posted in accordance with tlus paragraph and paragraph (C) of section 3781.111 <br />of the Revised Code shall be mounted on a fiixed or movable post, and the distance from the ground <br />to the top edge of the sign shall measure five feet. If a new sign or a replacement sign designating <br />a special pazking location is posted on or after the effective date of the Ordinance amending this <br />Section of the Traffic Code, there alsa sha]I be affnxed upon the surface of that sign or affiixed next <br />to the designating sign a notice that states the fine applicable for the affense of parking a motor <br />vehicle in the special designated parking locativn if the motor vehicle is not legally ernitled to be <br />parked in that location. <br />(b)(1) No person shall stop, stand, or park any motor vehicle at special parking locations <br />provided under paragraph (a) of this section or at special clearly marked parking tocations provided <br />4
