,, - <br />CITY OF NORTH OLMSTED <br />ORDINANCE NU. 2002-53 <br />BY: Council Members Kasler and Gareau. <br />AN ORDINANCE CREATING NEW SECTIDN 1161.16 OF CHAPT'ER 1161 <br />(OFFSTREET PARKING AND LOADIIVG) OF THE ZONING CODE PROVIDING <br />FOR THE ESTABLISHMENT AND MA,TNTENANCE OF HANDICAPPED PARSING <br />SPACES ON PROPERTIES ZONED GENERAL RETAIL BUSINESS DISTRICT OR <br />MIXED USE DISTRICT. <br />A'HEREA.S, SeCtion 351.20 of the Traffic Code presently provides for the estabfishment of <br />handicapped parking spaces upon properties developed for general retail business or mixed use; and <br />WHEREAS, the Director of Law has recammencied that these provisians be transferred from <br />the Traffic Code to the Zoning Code because they more properly relate to zoning, rather than traffic, <br />matters, and fiuther in order to clarify that enforcement of the said provisions should lie with the <br />Building Department; and <br />WHEREAS, it is the desire of this Council, in accordance with the recommendatian of the <br />Director of Law, to adopt legislation creating a new section in the Zoning Code groviding for the <br />establishment and maintenance of handicapped parking spaces on properties developed for general <br />retait business or mixed use; and <br />WHEREA.S, the Planning Cammission on the day of , 2002, by <br />formal motion, recommended that this Ordinance, creating new Section 1161.16 of the Zoning Code <br />be (approved)(disa.pproved); <br />NOW, THEREFORE, BE Tf ORDAINED BY THE COUNCIL OF THE CITY UF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF DHIO: <br />SEC'TION 1: That there be and hereby is created new Section 1161.16 of the Zoning Coda, <br />entitled "Handicapped Parking Spaces," which as created shall read in its entirety as fotlows: <br />1161.16 HANDICAPPED PARKING SPACES AND SIGNS. <br />(a) Every person desiring to develop property for general retail business purposes <br />located in a GEneral Retail Business District or a IVxed Use District, requiring more than twenty- <br />five parking spaces as specified in this Zoning Code, shaU be required to include in their parking <br />layout plan submitted to the Building Department, handicapped pazking spaces, the number of <br />which shall be determined as follows: <br />Ome handicapped space for every twenty-five pazking spaces; <br />Two handicapped spaces for every twenty-six to fifty parking spaces; <br />Three handicapped spaces for every fifty-one to ninety-nine parking spaces; <br />Four handicapped spaces for every 100 to 199 parking spaces; <br />
