<br />Ordinance No. 2002-56 <br />Page 2 <br />NOW, THEREFORE, BE IT 4RDAINED BY THE COUNCTL OF THE CTTY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OffiO: <br />SECTiON 1: That the Mayor be and is hereby authorized to receive proposals for the <br />design af influent controt gates for the Dover and Lebem pump stations consistent with the <br />May 2002 Pump Statiorts Influent Control Gates Praject Request for Proposcrl (Exhibit A). <br />SEC1`IO& 2: That the Mayor be and is hereby authorized to use the Agreement <br />prepared for cuntracting with a professional design firm for design of the influent control gates <br />for the Dover and Lebem pwnp stations (Exhibit B) in substantially the form now on file with <br />the Clerk of Council with only such changes therein as are not substantially adverse to the City <br />and which are approved by both the Mayor and the Director oFLaw. The character of any such <br />ehanges as not being svbstantially adverse to the City shall be evidenced conclusively by the <br />execution of the Agreement by the Mayor and the approval of the Agreement by the I}irector <br />of Law. <br />SECTION 3: That the Mayor be and is hereby authorized to enter into an Agreement <br />in an amoum not to exceed $25,000.00 with the professional design firm determined by the <br />Director of Public Service to be most qualified to perform the required services at a <br />compensation which is fair and reasonable to the City.. <br />SECTION 4: That this Ordinance is hereby declared to be an emergency measwe <br />immediately necessary for the preservatian of the public peace, health, safety and welfare, of <br />this city, for the further reason that this (hdinance is required to be immediately effective to <br />enable the City to further minimize the probability of discharging sanitary sewage to the <br />enviranment; fizrther provided it receives the affumative vote of two thirds of all mernbers of <br />Council, it shall take effect and be in force immediately upon its passage and approval by the <br />Mayor. <br />PASSED: ? ?L?(Lq J/ -4''"-;L <br />AT9TST: <br />,J 11?L ?LjL Lr f. /f ;7 <br />L8? ,Jl 2 <br />; Barbara L.
