GATES PROJECT <br />THiS AGREEMENT made as of the day af 2002 bY <br />and between the Ciri of NURTH OLMSTED hereinafter called the CITY, and (Name <br />and Address of the Design Professional Firm), hereinafter called the DESTiJN <br />PROFESSIONAL, is hereby set out as to tenns and conditions. <br />WITEREAS, The City owns and operates a sanitary sewer system (:the "North <br />Olmsted Sanitary Sewer System") which includes a collection systztn, lift stations, a <br />wastewater treatment plant and appurtenances, which system presently has the capaciry <br />to collect and treat certain wastewater originating outside the City's corporate boundaries; <br />and <br />WHEREAS, the capacity af the sanitary sewer system entering the Dover and <br />Lebern pump stations exceeds the pumping capacity of the twa stations; and <br />VAIEREAS, the Dover and Lebern pump :ytatians have been documented as nat <br />being able to continuauslv operate at their maximum pumping capacity during large <br />precipitation event5 due to higher than norrnal wet well elevations; and
