<br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2002 - 64 <br />BY: Mayor Musial <br />AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO <br />AN AGREEMENT WITH GEORGE SMERIGAN TO PROVIDE <br />PROFESSIONAL PLANNING SERVICES T4 THE CITY IN <br />CONIVECTION WITH THE REZONING OF THE APPROXIMA?'ELY <br />24-ACRE YACANT PARCEL OF LAND ALONG THE NORTH SIDE <br />OF BROOKPARK ROAD, BETWEEN GREAT NORTHE121V <br />BOULEYARD AND COLUMBIA ROAD, AND C4IKMONLY KNOWN <br />AS "PARCEL E, "AND DECI.ARING AN EMERGENCY. <br />WHEREAS, in North Olmsted Land Holdings v• North Olmsted, Case <br />Nos.330597 and 330969, the Court of Common Pleas for Cuyahoga County, Ohio, <br />dectared the present zoning of an approximately 24-acre vacant parcel of land along the <br />north side of Brookpark Road between Crreat Northern Boulevard and Columbia Road <br />(commonly known as "Parcel E"), for exclusive office use to be unconstitutional; and <br />R'HEREAS, the Court of Appeals for Cuyahoga County, Ohio, affirmed the said <br />decision of the Court of Common Pleas, and the Ohio Supreme Court has declined <br />jurisdiction over the case; and <br />WHEREAS, the City, having earhausted its appeals within the state court system, <br />is now under a final court order to timely rezone Parcel E to a new zoning classification <br />which bears a substantial relation to the public's safety, health and welfare; and <br />WHEREAS, the Director of Law has recommended that the City retain the <br />professional planning services of George Smerigan to assist the City in the said rezoning <br />of Parcel E; and <br />WHEREAS, it is accordingly the desire of this Council to authorize the Mayor to <br />enter inta an agreement with George Smerigan to provide the City with professional <br />planning services in connection with the rezoning of Parcel E; <br />NOW THEREFORE, BE IT ORDAINED BP THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he is hereby authorized to enter into an <br />agreemerrt with George Smerigan to provide professional planning services to the City in <br />connectian with the City's rezoning of an approximately 24-acre vacarn parcel of land an <br />the north side of Brookpark Road, between Great Northern Boulevard and Columbia <br />Road, common known as Parcel E. The compensation to be paid to the said professional <br />
