<br />AGREEMENT <br />6etween <br />CITY OF NURTH OLMSTED, OHIO <br />and <br />GEORGF, S11ERIGAN <br />for <br />PROFESSIQATAUFLANN1NG SERVICES <br />for the <br />RE7A1?ING OF VARCEL E PitE3JEiCT" <br />THIS AGREEMENT made at North Olmsted, Uhio, on the ; day of <br />, 2002 by and between the City of NQRT'H OLMSTED, 5200 Dover Center <br />Road, North Olmsted, Ohio 44070 [hereinafter referred to as "CITY"], and George <br />Smerigan, 10 West Erie Street, Suite 201, Painesville, Ohio 44077 [hereinafter referred to <br />as "CONTRACTOR"]; <br />WHEREAS, as a result of a decision of the Court of Common Pleas for Cuyahoga <br />County, Ohio, in the case of North Olmsted Land Holdings v. North Olmsted, Case Nos. <br />330597 and 330969, the City is under a final court order to rezone the approximately 24- <br />acre vacant parcel of land along the north side of Brookpark Road between Great <br />Northern Boulevard and Columbia Road (commonly known as "Parcel E"), to a new <br />zoning classification [hereinafter referred to as the "PROJECT"]; and <br />WHEREAS, the CITY' S Council, pursuant to Qrdinance 2002_ ; authorized <br />the Mayor to enter irito a contract with the CON'TRACTOR to provide the City with <br />professional planning services in connection with the PROJECT [hereinafter, the <br />"SERVICES"]; and
