Ordinance No. 2002-69 <br />SECTION 1: That the Director of Public Service be and is hereby authorized to <br />receive proposals for the design and preparation of drawings for the rehabilitation of the Low <br />Pressure Oxidation Building No. 1(LPO1) roof consistent with the June 2002 LPOI Roof <br />Rehabilitation Project Request for Proposal (Exhibit A). <br />SECTION 2: That the Mayor be and is hereby authorized to use the Agreement <br />prepared for contracting with a professional design firm for design and preparation of <br />drawings for the rehabilitation of the Low Pressure Oxidation Building No. 1(Exhibit B) in <br />substantially the form now on file with the Clerk of Councit with only such changes therein as <br />are not substantially adverse to the City and which are approved by both the Mayor and the <br />Director of Law. The character of any such changes as not being substantially adverse to the <br />City shall be evidenced conclusively by the execution of the Agreement by the Mayor and the <br />approval of the Agreement by the Director of Law. <br />SECTION 3: T'hat the Mayor be and is hereby autharized to enter into an Agreement <br />in an amount not to exceed $25,000 upon approval by the Board of Control with the <br />professional design firm that submits the proposal deemed to be most qualified to perform the <br />required professional services at a compensation which is fair and reasonable to the City. <br />SECTION 4: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public peace, health, safety and welfare, of <br />this city and for the further reason that this Ordinance is required to be immeaiately effective <br />to enable the City to protect an existing building and existing odor control equipment at the <br />North Olmsted Wastewater Treatment Plant; and further provided it receives the affirmative <br />vote of two-thirds of all members of Council, it shall take effect and be in force immediately <br />upon its passage and approval by the Mayor. <br />PASSED: 3-- <br />ATTEST: <br />L.
