Ordinance No. 2002-73 <br />Page 2 <br />WHEREAS, the Director of Public Service has determined that FLOYD <br />BROWNE ASSOCIATES, INC. on May 1, 2002 provided the City with reasonable and <br />competitive quotation in the amount of $15, 500.00 for preparation of an Olmsted <br />Township Sanitary Sewer System Master Plan; and <br />WHEREAS, it is the desire of this Council to dispense with an RFP process for <br />the selection of an engineer to provide the said professional services, beca.use FLOYD <br />BROWN ASSOCIATES, INC. is the owner of the original master plan for the Sewer <br />District, and therefore is most qualified to prepare the new master plan; and <br />WHEREAS, it is the desire of this Council to authorize the Mayor to enter into <br />an Agreement with FLOYD BROWNE ASSOCIATES, INC. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE <br />CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he hereby is authorized to, upon approval <br />of the Board of Control, enter into an Agreement with FLOYD BROWNE <br />ASSOCIATES, INC. providing for the creation of a new Sanitary Sewer System Master <br />Plan as described in the Title and Preamble of this Ordinance. The Ageement shall be <br />substantially in the form of the Agreement attached to this 4rdinance as Exhibit A. <br />Council hereby authorizes the expenditure of funds, in an amount not to exceed <br />$15,500.00, for the services to be provided to the City under this Agreement. <br />SECTION 2: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and <br />for the further reason that it is necessary that this Ordinance go into effect immediately so <br />that planning for the Willow Woods Subdivision may be completed before construction <br />of the subdivision is scheduled to begin, and further provided it receives the affirmative <br />vote of twathirds of all members of Council, it shall take effect and be in force <br />immediately upon its passage and approval by the Mayor. <br />PASSED: First Reading: 1-4, o `?-- <br />?" ?
