EXHIBIT A <br />AGREEMENT TO PURCHASE REAL PROPERTY <br />t <br />This Ageement, entered into at North Olmsted, Ohio this Z f? day of Jvn e , 2002 <br />by and between the City of North Olmsted, 5200 Dover Center Road, North Olmsted, Ohio <br />44070 (hereinafter, the "Purchaser"), and The Clague Towers Condominium Owners' <br />Association, Inc., 3675 Clague Road, North Olmsted, Ohio 44070 (hereinafter the "Seller") <br />WHEREAS, it is the desire of the Seller to sell, and the Purchaser to purchase, a certain <br />portion of the real property located at 3675 Clague Road, North Olmsted, Ohio (Permanent <br />Pazcel Numbers 231-12-001 through 231-12-395), which shall become part of the right-of-way in <br />connection with the proposed widening of Clague Road; and <br />WHEREAS, the purchase of this property has been authorized by North Olmsted <br />Ordinance Number 2002-77- <br />NOW THEREFORE, on the basis of the foregoing premise, for the consideration <br />hereinafter recited, and on the conditions and terms which follow, the parties agree as follows: <br />ITEM ONE: Purc6ase and Sale of Real Prouertv <br />Subject to the terms and conditions of this Agreement, the Seller agrees to sell and the <br />Purchaser agrees to purchase a11 of the Seller's right, title and interest in the above-mentioned part <br />of the real property, which is located at 3675 Clague Road, North Olmsted, Ohio. The real <br />property being sold is a more or less rectangular piece of land abutting the right of way along <br />Clague Road, 2.23 feet wide along its north side and 12.98 feet wide along its south side, and <br />consisting of a total of 1,343 square feet, and legally described in attached Exhibit "A," and <br />depicted on the plat marked as Exhibit "B." In addition, Seller agrees that it sha11 fully cooperate
