763.03 PERNIIT APPLICATION AND ISSUANCE. <br />(a) During the month of December of each year, every operator or tattoo artist <br />of a tattoo operation or dermagraphic art studio proposing to operate a tattoo operation <br />during any part of the next year shall apply for a permit from the City of North Olmsted. <br />(b) Any person who, subsequent to January 1 of any year, proposes to operate <br />a tattoo operation during any remaining part of the year, after the effective date of this <br />chapter, shall apply for a permit from the City of North Olmsted no less than ten (10) <br />days before the tattoo operation is to be opened for business. <br />763.04 PERNIIT DE1vIAL, REVOCATION OR SUSPENSION. <br />A permit to operate a tattoo operation or dermagraphic art studio may be denied, <br />suspended or revoked by the City of North Olmsted and/or the Cuyahoga Courny Board <br />of Health upon failure of the applicant to meet or maintain the requirements of this <br />chapter or by violation by the permit holder of any of the terms of this chapter. The <br />applicant or permittee, as the case may be, may appeal any denial, suspension or <br />revocation of the permit by submitting notice of such request for appeal to the Secretary <br />of the Planning Commission within fourteen (14) days of receipt of notice of such denial, <br />suspension or revocation. The Planning Commission shall hear such appeal in <br />accordance with the procedures afforded by these Codified Ordinances in matters of <br />appeal to said Commission. <br />763.05 PLAN REQUIREMENTS. <br />(a) No person shall construct, install, operate, equip or extensively alter a <br />tattoo operation until the plans therefor have been submitted to and approved in writing <br />by the City of North Olmsted. When such plans are submitted to the City of North <br />Olmsted, they shall be acted upon by the City within forty-five (45) days after the date of <br />receipt. <br />(b) The plans and specifications submitted for the approval of the City of <br />North Olmsted shall clearly show and describe what applicable provisions of this chapter <br />shall be adequately met, and shall include: <br />(1) The total area (square feet) to be used for the tattoo operation. <br />(2) Entrances and exits. <br />(3) Location, number and types of plumbing fixtures, including all water <br />supply facilities. <br />(4) Plan of lighting, both natural and artificial. <br />(c ) All equipment, both new and used, to be utilized in the tattoo operation <br />must be approved by the Health Commissioner. <br />(d) No tattoo operation shall be conducted in any zoned residential area, nor <br />shall any such operation be conducted within 500 feet of any zoned residential property <br />or any school, public library, church or day care center. <br />
