763.06 M[NIMUM SA1vITATION STANDARDS. <br />(a) Prior to Tattooin& <br />(1) Medical historv. The operator shall inquire of a patron on a written <br />questionnaire for the following medical conditions: <br />(A) History of j aundice or hepatitis; <br />(B) History of lymphadenopathy or lymphadenitis (swelling of lymph <br />nodes); <br />(C) History of AIDS, positive HIV test; <br />(D) History of blood donation exclusion (for other than hypertension <br />and immediate illness); <br />(E) History of skin disease or skin cancer; and <br />(F) History of allergies that have caused an anaphylactic reaction. <br />Persons indicating a history of any of the above shall not be tattooed. <br />(2) Intoxicated persons. Any individual who is inebriated or obviously under <br />the effects of alcohol and/or drugs shall not be tattooed. <br />(3) Underage persons. The operator shall verify the age of the patron, <br />confirmed by a driver's license or State identification card. No person <br />under nineteen (19) years of age shall be tattooed without the prior <br />express, verified, written consent of such person's parents and/or <br />guardians. <br />(b) Onerator or Tattoo Artist. <br />(1) Clothiniz. All operators, while tattooing, shall wear light-colored, clean, <br />washable covering garments. <br />(2) Hand washing. Immediately prior to beginning any tattooing operation, <br />each operator shall wash his or her hands in running water for at least <br />three (3) minutes with liquid or ganulated soap, or equivalent, as <br />approved by the Health Commissioner. An individual handwashing brush <br />shall be used by each operator. After washing hands, as herein required, <br />the operator shall rinse his or her hands in seventy (70%) percent alcohol <br />(rubbing alcohol) or in an antiseptic solution approved by the Health <br />Commissioner. The operator's fingernails shall be kept clean and short <br />with no rings. <br />(3) Examination gloves. The operator shall wear and then discard a separate <br />set of disposable examination gloves for each client. Should the gloves <br />develop a break or tear, they shall be immediately replaced. <br />(4) Lap Cloths. All operators who utilize lap cloths shall launder the lap cloth <br />at least daily. <br />(5) No Smoking. There shall be no smoking by patrons, guests or the <br />operator during the tattooing operation. <br />(c) The Tattooinp, Operation. <br />(1) Tattooing Surface. Tattooing shall be done on a normal healthy skin <br />surface. No tattooing shall be done on scar tissue. No tattooing operator <br />shall remove tattoo marks. <br />(Z) Razorsbeedles. Separate disposable razors with single service blades, and <br />separate disposable needles, shall be used for each patron and then <br />discarded in accordance with all applicable rules and regulations. <br />
