WHEREAS, during the period 1992 through 1994, the City borrowed monies to construct certain major wastewater disinfeetion capital improvements to the North Olmsted Sanitary Sewer System's wastewater treatment plant; and WHEREAS, in 1992, the City boffowed monies to construct a new natural gas main distribution system inside the Sanitary Sewer System's wastewater treatment property; and WHEREAS, in 1994, the City boffowed monies to construct new water, gas and electric services into the Sanitary Sewer System's wastewater treatment plant property; and WHEREAS, during the period 1994 through 1995, the City boffowed monies to construct certain major wet stream, odor control, electrical distribution and process control capital improvements to the Sanitary Sewer System's wastewater treatment plant; and WHEREAS, during the period 1996 through 1997, the City boffowed monies to construct a new East Interceptor Relief Sewer for the Sanitary Sewer System; and WHEREAS, this Council finds it necessary and appropriate to authorize the Mayor to enter into an agreement with the City of Fairview Park amending the Capital Charges Agreement with the City of Fairview Park to pravide for the assessmerrt of additional debt service charges to the Fairview Park Service Area relating to the loans made for the aforementioned five capital improvement projects from 1992 to 1997 which, in part, benefited the Fairview Park Service Area; and WHEREAS, the City, being authorized by Article XVIII af the Ohio Constitution, and the City of Fairview Park, acting under authority of the Ohio Revised Code, including Chapter 6117 thereof, each are fully empowered to enter into such an agreement; and WHEREAS, the proposed amendments to the Capital Charges Agreement, have been reviewed and approved by the City of Fairview Park, and have been filed with the Clerk of Council; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION 1: That it is hereby deternuned to be necessary for the City to enter into an Agreement amending the existing Capital Charges Agreement with the City of Fairview Park, Ohio, in order to provide for the assessment of additional debt service charges to the Fairview Pazk Service Area relating to the loans made for the aforemernioned five capital improvemern projects from 1992 to 1997 which, in part, benefited the Fairview Park Service Area, and under which the Fairview Park Service Area will continue to be served by the North Olmsted Sanitary Sewer System. The amendments to the Capital Charges Agreement are hereby approved in substantially the form of the Agreement that is on file with the Clerk of Council, and the Capital Charges Agreement is hereby amended as provided in the said Agreement. 2
