SECTION 2: That the Mayor be and he is hereby authorized and directed to execute the <br />Agreement in substantially the form now on file with the Clerk of Council, with only such changes <br />therein as are not substantially adverse to the City and as are approved by the Mayor and the Director <br />of Law. The character of any such changes as not being substantially adverse to the City shall be <br />evidenced conclusively by the execution of the Ageement by the Mayor and the approval of the <br />Agreement by the Director of Law. A copy of the Agreement, entitled "First Amendment to Capital <br />Charges Agreement by and between City of North Olmsted, Ohio, and City of Fairview Park, Ohio," <br />is attached to this Ordinance as "Exhibit A." <br />SECTION 3: That this Council finds and deternunes that a11 formal actions of this Council <br />concerning and relating to the passage of this Ordinance were taken in open meetings of this Council <br />and that all deliberations of this Council and of any of its committees that resulted in those formal <br />actions were in meetings open to the public in compliance with the law. <br />SECTION 4: That this Ordinance is hereby declared to be an emergency measure necessary <br />for the immediate preservation of the public peace, health, safety and welfare, of this City and for the <br />further reason that this Ordinance is required to be immediately effective to enable the City to <br />implement the Agreeinent and begin collecting the new debt service charges in the Fairview Park <br />Service Area in accordance with the terms of the Agreement and to protect the fiscal integrity of the <br />Sewer Revenue Fund; and further provided that it receives the affiimative vote of two-thirds of all <br />members of Council, it shall take effect and be in force irrunetliately upon its passage and approval by the <br />Mayor. <br />PASSED: <br />? <br />ATTEST.• <br />/ ],4" 6L&u -> <br />ARBARA L.
