CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2008 -120 <br />BY: Mayor O'Grady <br />AN ORDINANCE DISPENSING WITH AN RFP PROCESS AND <br />AUTHORIZING THE MAYOR TO ENTER INTO A CONTRACT WITH <br />JOHNSON, MILLER & SCHMITZ LLP PROVIDING FOR THE LATTER <br />TO CONTINUE TO SERVE AS THE CITY'S LABOR NEGOTIATOR, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, Section 4117.10 of the Ohio Revised Code designates the mayor of a <br />municipal corporation as the official "responsible for negotiations in the collective bargair;ng <br />process;" and <br />WHEREAS, the law firm of Johnson, Miller & Schmitz, or one of its predecessor law <br />firms [hereinafter "the Johnson law firm"], has since 2002 provided labar negotiator services to <br />the City; and <br />WHEREAS, the Johnson law firm was most recently selected in 2006 through an RFP <br />process authorized by this Council to serve as the City's labor negotiator for the City's labor <br />contracts with terms ending in 2006 and 2007; and <br />WHEREAS, this Council in February of this year, at the Mayor's request, adopted <br />Resolution No. 2008-24 providing for an extension of the Johnson law firm's contract in order to <br />complete by the end of the 2008 calendar year the negotiations for the labor contracts with terms <br />ending in 2006 and 2007; and <br />WHEREAS, the Mayar is satisfied with the services provided by the Johnson law tirm <br />and, in the interest of maintaining consistency in management positions by retaining the same <br />labor negotiator, desires to continue to employ the Johnson law firm to serve as the City's labor <br />negotiator for the City's labor contracts that have terms ending in 2008 and 2009; and <br />WHEREAS, this Council, acting upon the recommendation of the Mayor, desi res to <br />dispense with the RFP process otherwise required by Chapter 112 of the North Olmsted Codified <br />Ordinances and authorize the Mayor to enter into a new contract with the Johnson law firm <br />providing for the latter to serve as the City's labor negotiator for City labor contracts with terms <br />ending in 2008 and 2009; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the formal RFP process required by Chapter 112 of the Codified <br />Ordinances of the City of North Olmsted is hereby dispensed with by reason of the continuing <br />professional relationship between the City and the law firm of Johnson, Miller & Schmitz L,LP, <br />and the Mayor be and he hereby is authorized to enter into a contract with Johnson, Miller & <br />Schmitz LLP, to provide labor negotiator services to the City for the City's labor contracts with <br />terms ending in 2008 and 2009.
