<br />Ordinance No. 2008-120 <br />SECTION 2: That the said contract shall be in final form and substance substantially <br />the same as the Agreement for Labor Negotiator and Outside Legal Services attached to this <br />Ordinance as "Exhibit A," with only such changes thereto in the form and substance of the <br />Agreement that are not substantially adverse to the City. The character of any such changes as <br />not being substantially adverse to the City shall be evidenced conclusively by the execution of <br />the Agreement by the Mayor and the approval of the Agreement by the Director of Law. In <br />addition, the Agreement shall provide for Johnson, Miller & Schmitz LLP to provide labor <br />negotiator services only, and not outside legal services. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />reason that this legislation must go into effect immediately because the City has recently been <br />served by the Fraternal Order of Police with a formal Notice to Negotiate to which the City must <br />timely respond; and further provided it receives the affirmative vote of two-thirds of all members <br />of Council, it shall take effect and be in force immediately upon its passage and approval by the <br />Mayor. <br />PASSED: L LC <br />ATTEST.• <br />? <br />Zat,_ <br />ARBARA L.
