CITY OF NORTH OLMSTED ORDINANCE NO. 2008 -17 BY: Mayor O'Grady AN ORDINANCE AMENDING SECTIONS 1139.01, 1145.01, AND 1145.03 OF THE ZONING CODE IN ORDER TO ESTABLISH REGULATIONS PROVIDING FOR THE LOCATION OF RECYCLING FACILITIES AND RECYCLING COLLECTION CENTERS IN THE CITY OF NORTH OLMSTED, AS AMENDED. WHEREAS, the City's Zoning Code should be continually reviewed and updated, as business practices and business concepts change, in order to insure that its regulations provide opportunities for new businesses to locate in appropriate zoning districts of the City, while at the same time also insuring that such business will not cause injury to the health, safety or welfare of the general public; and WHEREAS, the City's Zoning Code does not currently provide for the location of recycling facilities or recyclable collection centers in any zoning district of the City of North Olmsted; and WHEREAS, it is the recommendation of the Director of Planning that the City's Zoning Code be amended to provide for the location of recycling facilities only in the Limited Industry- Industrial Park District of the City and for the location of recycling collection centers either in the Limited Industry-Industrial Park District of the City, or, with a conditional use permit issued subject to the provisions of Chapter 1118 of the City Zoning Code, in the General Retail District of the City, all in a manner that furthers the health, safety and welfare of the general public; and WHEREAS, it is the desire of this Council to accordingly amend Sections 1139.01, 1145.01, and 1145.03 of the Zoning Code, as expressly recommended by the Director of Planning in order to provide such regulations for recycling facilities and recycling collection centers in appropriate zoning districts within the City of North Olmsted; and ---??WHEREAS, the Planning & Design Commission on fhe ,, 7 day of 2008, by formal motion, (recom_mened - did not recommend) (with suggested change ) that this Ordinance be adopted; and WHEREAS, following publication of newspaper notice in conformance with the provisions of Section 14 of Article IV of the Charter of the City of North Olmsted and Section 1127.03 of the North Olmsted Zo?} ng Code, a public hearing was held on this proposed legislation on the A day of ? f" J? .c:-t , 2008; ?j NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION 1: That Section 1139.01 ("General Retail Business District") in Chapter 1139 ("General Retail Business District"), and Sections 1145.01 ("Definitions") and 1145.03 ("Uses Permitted") in Chapter 1145 ("Limited Industry-Industrial Park District) of the City of North Olmsted Zoning Code, which presently read in their entirety as set forth in the documents
