CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2008 - 18 <br />BY: Mayor O'Grady <br />AN ORDINANCE PROVIDING FOR THE AMENDMENT OF <br />THE ZONING MAP OF THE CITY OF NORTH OLMSTED <br />BY REZONING PERMANENT PARCEL NUMBER 234-20- <br />049, LOCATED AT 5764 STEARNS ROAD, FROM ITS <br />CURRENT ZONING CLASSIFICATION OF ONE FAMILY <br />RESIDENCE DISTRICT USE TO GENERAL RETAIL <br />B USINESS DISTRICT USE. <br />WHEREAS, BP proposes to redevelop the southwest corner of Stearns Road and Lorain <br />Road for the purposes of constructing and thereafter operating a new gas station there; and <br />WHEREAS, the BP proposal involves three parcels of land-two that are located along <br />Lorain Road in the General Retail Business District of the City and one at 5764 Stearns Road <br />that is located immediately to the south of and abuts the two commercially zoned parcels, but <br />which is presently zoned for one family residence district use only; and <br />WHEREAS, the said two commercial parcels have each lost or are in the process of <br />losing significant square footage as a result of the Stearns-Crocker Extension road project, w'.:ch <br />has taken land from each of the said two commercial parcels in order to expand Stearns Road to <br />four lanes and to create a new turn lane from Lorain Road onto Stearns Road; and <br />WHEREAS, the City's Director of Planning recommends that this Council rezone the <br />third parcel identified in the BP proposal, which is located at 5764 Stearns Road and known as <br />Permanent Parcel Number 234-20-049, from it present zoning classification of One Family <br />Residence District to General Retail Business District in order to provide BP with sufficient total <br />acreage on the southwest corner of Stearns Road and Lorain Road in order to develop a quality <br />gas station that serves the needs of the motoring public, is aesthetically attractive, and does not <br />negatively impact upon nearby residences; and <br />WHEREAS, the recommended rezoning of Permanent Parcel Number 234-20-049 to <br />General Retail Business is not inconsistent with the City's Master Plan; and <br />WHEREAS, this Council, acting upon the recommendation of the Director of Planning <br />and upon its review of the City Master Plan, finds that the proposed rezoning of Permanent <br />Parcel Number 234-20-049, located at 5764 Stearns Road, from One Family Residence District <br />to General Retail Business District, bears a substantial relation to the public health, safety, and <br />welfare, and that specifically said rezoning will promote orderly redevelopment of the southwest <br />corner of Stearns Road and Lorain Road in a way that is compatible with the character of and <br />uses upon surrounding parcels of land in the area; will provide the owner of the said parcel of <br />land with a reasonable return upon his land investment, and will protect the health, safety and <br />welfare of nearby residents; and <br />
