<br />Kesolution No. 2008 - <br />changes therein as are not substantially adverse to the City and which are approved by the <br />Director of Law. The character of any such changes as not being substantially adverse to the City <br />shall be evidenced conclusively by the execution of the agreement by the Mayor and the approval <br />of the agreement by the Director of Law. <br />SECTION 3: That Council adopts and incorporates separate but related approval of a <br />Settlement and Release Agreement with Cleveland Communications, lnc., so as to simultaneously <br />resolve any dispute over the City's previous occupation and use of the radio communications <br />tower and to also enable the City to proceed with this Sublease to provide for continued <br />occupation and use at the same time. <br />SECTION 4: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public peace, health, safety and welfare, of this <br />City and for the further reason that this Resolution is required to be immediately effective <br />because the City's property interest and the status of its Service and Safety radio communication <br />equipment must be preserved and documented; and further provided it receives the affirmative <br />vote of two-thirds of all members of Council, it shall take effect and be in force immediately upon <br />its passage and approval by the Mayor. <br />P.9SSED: First Reudin <br />g: 1 x__--- 1 <br />Second Reading: <br />7hird Reading: <br />-- <br />Committee: <br />?. <br />:4 '!
