ARTICLE XVl GRIEVANCE PROCEDURE <br />16.01 The term grievance shall mean an allegation by a bargaining unit employee that there has <br />beeil a breach, misinterpretation, or improper application of tllis agreenient. <br />16.02 A grievance may be filed by airy lnember of the bargaining uiut. Where a group of <br />bargainiilg unii members desire to file a grievance involving a situation affecting the group, a <br />member shall be designated by such group to process the grievance. Such grievance shall be <br />defined as a group grievance. The names of each member, on behalf of which the grievance is <br />filed, shall be made available at the first hearing. Group grievances shall be presented in the first <br />instance to the supervisor common to all einployees in the group. The grievance procedure <br />outlined in Section 16.05 shall be used throughout. <br />16.03 All grievances must be processed and answered at the proper step in the grievance <br />progression to be considered at the next step. An_y grievance that is not timely appealed to the <br />neat step of the procedure, will be deemed to have been settled on the basis of the Employers <br />answer at the last coinpleted step. <br />Time limits set forth herein may only be extended by mutual agreement of the parties. <br />The aggrieved may withdraw a grievance at any point by submitting, in writing, a statement to <br />that affect, or by perinittlllg the time requirements at any step to lapse without further appeal. <br />Any grievance not answered by the Employer or his designee witlun the stipulated time limits <br />shall be considered to have been appealed to the next step in the grievance procedure. <br />16.04 Written grievances inust be filed on the form provided by flle FOP and shall contain, but <br />not be limited to, the following inforination. <br />l. Date and tiine grievance occurred; <br />2. Description of incident giving rise to the grievance; <br />3. Articles and sections of the agreenlent involved; <br />4. Relief requested; <br />5. Signature of the employee. <br />16.05 The following steps shall be followed in the processing of a grievance. <br />Step 1. Within five (5) working days of the incident or l:nowledge of the incident <br />(but ii1 no case later than fifteen (15) calendar days from the actual facts which give rise to the <br />grievance, the aggrieved employee shall submit his written grievance to the Shift Lieutenant, or <br />his desigilee, who shall indicate the date and time of receipt of the grievance, and affix his <br />signature to the grievance forni. That Shift Lieutenant shall respond in writing to the grievant <br />within five (5) worlcii7g days of receipt of the grievance. <br />Step 2. A grievance tuu-esolved at Step 1 may be submitted by the grievant to the <br />Chief of Police, or his designee, withill five (5) worlcing days fi-om receipt of the Step 1 answer. <br />It shall be the responsibility of the Chief of Police, or his designee, to investigate tlle marier, hold <br />such heariiigs as necessary, and to provide a written response to the grievanti within the (10) <br />12
