ARTTCLE Il1 FOP REPRLSENTATION <br />3.01 Non-employee representation of the FOP shall be admitted to the Employer's facility for <br />the purpose of processing grievances, attending meetings, or for monitoring the adininistration oi- <br />Chis Agreement, upon approval of the Employer ar his designee. The Employer or his designee <br />shall facilitate any necessary contact between the representative and any on duty employee, <br />provided that arrangement of the contact is not unduly disruptive of the employees job <br />responsibilities. <br />3.02 The FOP shall have use of suitable bulletin boards for ihe posting of FOP notices ol- other <br />inaterials. The boards shall be identified with the name of the FOP, and the FOP may designate <br />persons responsible therefore. <br />3.03 The Employer shall during wage/contract negotiations, endeavor to schedule time for <br />members of the negotiation team to participate in the negotiations withoui having to have worked <br />the 11:00 p.in. to 7:00 a.m. shift immediately prior to any negotiation session. <br />ARTICLE N AGENCY SHOP/DUES DEDUCTION <br />4.01 All employees in the bargaining unit shall either become dues paying members of the <br />FOP. or, as a condition of continued einployment, remit to the FOP a fair share fee in accord <br />with the provisions of Ohio Revised Code Sectioi14117.09(C). <br />4.02 Any newly hired employees in the bargainuig unit shall, within sixty (60) days of date of <br />employment, either elect to become members of the FOP or remit the fair share fee. As provided <br />in Ohio Revised Code Section 4117.09(C), nothing in this Article shall be deemed to require any <br />employee to become a men7ber of the FOP <br />4.03 The Employer agrees to deduct FOP dues and fees from any member of the bargaining <br />unit who provides written authorization for a payroll dues and fees deduction. 'I'he FOP shall <br />indemnify the Employer and hold it harmless against any and all claims, demands, suits ar other <br />liability that may arise by reason of any action of the Employer in complying with the provisions <br />of this Article. <br />4.04 Local Dues Deduct: The Employer shall deduct local Western Cuyahoga Lodge #25 <br />membership dues in the amount certified by Lodge 425 to the Einployer. Said dues will be <br />deducted annually from the first paycheck of each year from the employees authorizing such <br />deduction. <br />ARTICLE V WORK WEEK/SCHEDLILED HOURS <br />5.01 For the purpose of this agreement, a workday is defined as continuous eight (8) hour <br />period in any twenty-four hour period, except during those peri_ods which a double back occurs. <br />A double back is defined as the work period in which an employee coinpletes a shift and starts <br />another shift or assignment within the saine twenty-four hour period. Double backs required by <br />the Employer will be paid at tiine and a half. A workweek is defined as forty (40) hours.
