AGREEMENT <br />This Agreement is inade between the City of North Olmsted (hereinafter referred to as <br />the ("Employer "), and the Fraternal Order of Police/Ohio Labor Council (hereinafter referred to <br />as the "FOP"). <br />The purpose of this Agreement is to provide a fair and reasonable rnethod of enabling <br />employees covered by this Agreement to participate, through representation, in the establishment <br />of terms and conditions of their employment, and to establish a peaceful procedure far the <br />resolution of differences between the parties. <br />ARTICLE I RECOGNITION <br />1.01 The Employer recogiuzes the FOP as the sole and exclusive bargaining representative <br />for all full-time sworn employees of the Employer comprising two bargaining units, with one <br />(1) bargaining unit including all full-time patrolmen and one (1) bargaining unit including all <br />full-time sergeants, lieutenants and captains, excluding the Chief of Police and all other <br />employees for the purpose of collective bargaining with respect to wages, hours, ternls and other <br />conditions of employment. <br />1.02 Management shall not attempt to erode the bargaining units ar the rights of bargaining <br />unit einployees. Except in emergency circuinstances, work normally performed by bargaining <br />unit members shall first be offered to bargaining unit members. This Article shall also apply to <br />special duty or special assignments which result from requests by private individuals or groups <br />for security or traffic-control. <br />ARTICLE II NON-DISCRIMINATION <br />2.01 Both the Employer and the FOP recognize their respective responsibilities under the <br />Federal and State Civil Rights Laws, Fair Employment Practices Acts, and other similar <br />constitutional and statutory requirements. Therefore, both the Employer and the FOP hereby <br />reaffirm their commitments, legal and moral, not to discriminate in any manner relating to <br />employinent on the basis of race, color, religion, national origin, disability, sex or age. <br />Furthennore, the provisions of the Agreement shall be applied equally to all employees in the <br />bargaining unit without discrimination as to age, marital status, race, sex, religion, color, national <br />origin or political affiliation. The FOP shall share equally with the Ciry the responsibility for <br />applying this provision of the Agreement. <br />2.02 The Employer agrees not to interfere with the rights of employees to become inembers <br />of the FOP and there shall be no discriinination, interference, restraint or coercion by Einployer <br />or FOP representatives against any employee(s) because of FOP inembership or lack of FOP <br />inembership.
