Ordinance No. 2008-44 <br />(oh) Annual Review of Code Provisions and Onerations. The Property <br />Maintenance Officer shall, in the month of January of each year, review with the Fire <br />Chief, the City Engineer, and the Director of Law the procedure and operation of this <br />Code, and report to Council on or before March 15: <br />(1) Any recommended amendment, addition or modification of a <br />provision of this Code consonant with the field experience of the <br />personnel charged with enforcement; <br />(2) A summary of the time sequence enforcement experience <br />indicating the number of violations abated, the number of cases <br />processed in the Municipal Court, the number of inspections made <br />and such other and further pertinent information as will provide <br />Council with an annual account of progress in securing the <br />standards required by this Code; and <br />(3) Any further recommendation as to how this Code and the <br />procedures and operations hereunder can be improved. <br />SECTION 5: That Section 1363.99 of the Building Code, which presently reads as <br />follows: <br />1363.99 PENALTY; EQUITABLE REMEDIES. <br />(a) Penalt . Whoever violates any provision of this chapter is guilty of a <br />minor misdemeanor for each offense. Each violation of a section or part of a section of <br />this chapter shall constitute a separate and distinct violation independent of any other <br />section or part of a section or any order issued pursuant ta this chapter. Each day of <br />failure by any person after notice and final order to comply with any section or part of a <br />section shall constitute a separate offense. <br />(b) Application of Penaltv to Officers or Agents• Where the defendant is <br />other than a natural person, subsection (a) hereof shall also apply to any agent, <br />superintendent, officer, member or partner who, alone or with others, has charge, care or <br />control of the premises <br />(c) Equitable Remedies. The imposition of any penalty shall not preclude the <br />Director of Law or Prosecutor from instituting an appropnate action or proceeding in a <br />court of proper jurisdiction to prevent an unlawful repair or maintenance; or to restrain, <br />correct ar abate a violation; or to prevent the occupancy af a building, structure or <br />premises; or to require compliance with the provisions of this Code or other applicable <br />laws, ordinances, rules or regulations or the orders or determinations of the Property <br />Maintenance Officer ar the Board of Building Code Appeals. <br />BE AMENDED, AND, A5 AMENDED, SHALL READ AS FOLLOWS: <br />22 <br />1363.99 PENALTY; EQUITABLE REMEDIES.
