<br />Ordinance No. 2008-44 <br />(a) Whoever fails to make the payment provided in Section 1363.07(f) <br />due to a violation of 1363.07(b)(1)(C), 1363.07(b)(1)(D), 1363.07(b)(1)(F) and <br />1363.07(b)(2)(A)(1) shall be guilty of an unclassified misdemeanor. If the citation <br />for such violations is not paid within a seventy-two hour period as provided for <br />pursuant to Section 1363.08(e), then the Building Department shall issue at least <br />one (1) written communication to the owner of the property at the address shown <br />in the office of the County Auditor and advise the owner of the citation. Such <br />written communication shall be forwarded by regular mail and shall further <br />advise that any unpaid citation will be forwarded to the Rocky River Municipal <br />Court, by a date specific, not less than ten (10) days from the date of such <br />correspondence, for further proceedings and prosecution of the violation, subject <br />to the imposition of Court costs and a fine not to exceed one hundred fifty dollars <br />($150.00). <br />(eg) Equitable Remedies. The imposition of any penalty shall not preclude the <br />Director of Law or Prosecutor from instituting an appropriate action or proceeding in a <br />court of proper jurisdiction to prevent an unlawful repair or maintenance; or to restrain, <br />correct or abate a violation; or to prevent the occupancy of a building, structure or <br />premises; or to require compliance with the provisions of this Code or other applicable <br />laws, ordinances, rules or regulations or the orders or determinations of the Property <br />Maintenance Officer or the Board of Building Code Appeals. <br />SECTION 5: That all Ordinances or resolutions or parts of ordinances or resolutions <br />that are in conflict or inconsistent with this Ordinance are, to the extent of such conflict <br />or inconsistency, hereby repealed. <br />23 <br />(6c) Application of Penalty to Officers or Agents. Where the defendant is <br />other than a natural person, subsection (a) hereof shall also apply to any agent, <br />superintendent, officer, member or partner who, alone or with others, has charge, care or <br />control of the premises
