E <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2008 - 56 <br />By: Mayor O'Grady <br />AN ORDINANCE AMENDING SECTION 1139.01 OF CHAPTER <br />1139 (BZISINESS DISTRICTS) OF THE PLANNING AND ZONING <br />CODE IN ORDER TO REGULATE THE PLACEMENT OF <br />CHARITABLE COLLECTION BIN STORAGE CONTAINERS IN <br />THE GENERAL RETAIL BUSINESS DISTRICT OF THE CITY OF <br />NORTH OLMSTED. <br />WHEREAS, the request for use of charitable collection bins or storage containers, <br />sometimes referred to as Charitable Collection Boxes (CCB), has increased in <br />commercial areas of the City of North Olmsted; and <br />WHEREAS, this Council has considered, in Ordinance 2007-82, whether to <br />amend business regulation of second dealers in North Olmsted Chapter 755 in order to <br />provide for and regulate the location of said CCB, and therein discussed the health, safety <br />and aesthetic considerations of such accessory uses; and <br />WHEREAS, this Council finds, based upon recoinmendations by the Directors of <br />Planning and Public Safety, and the Building Commissioner, that the placement of CCB <br />other than in accordance with regulations limiting the quantity, size and locations, would <br />have a negative adverse impact on both safety and aesthetics and should be regulated iri <br />order to maintain the appearance of commercial areas and protect the safety of vehicular <br />and pedestrian travelers; and <br />WHEREAS, it is the desire of this Council to accordingly amend Section 1139.01 <br />of the Zoning Code, as recommended by the Directors of Planning and Public Safety, and <br />the Building Commissioner, to appropriately regulate the placement of CCB in <br />commercial areas in North Olmsted; and <br />WHEREAS, the Planning & Design Comrnission on the d day of <br />I , , 2008, by formal motion, (recommended - did not recommend) (with <br />suigestedthanges) that this Ordinance be adopted; and <br />WHEREAS, following publication of newspaper notice in conformance with the <br />provisions of Section 14 of Article IV of the Charter of the City of North Olmsted and <br />Section 1127.03 of the North Olmsted Zo ' Code, a public hearing was held on this <br />proposed legislation on the day of 2008; <br />Ii <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA, .AND STATE OF OHIO:
