Ordinance No. 2008-56 <br />SECTION 1: That Section 1139.01 of the Zoning Code, which presently <br />reads as follows: <br />1139.01 GENERAL RETAIL BUSINESS DISTRICT. <br />(a) Intent. For the purposes of the Zoning Code, General Retail Business <br />Districts are hereby established to meet the shopping, convenience and service needs <br />of the residents of the entire community and shall be established in a manner to protect <br />adjacent residential neighborhoods by regulating the types of business uses, which <br />could create hazards, noise, odors or other objectionable influences.. <br />(b) Permitted Buildings and Uses. In a General Retail Business District, <br />land may be used and buildings may be designed, built, altered or used only for one or <br />more of the following permitted uses. <br />(1) Any use permitted in the least restrictive Residence District <br />adjacent to any part of such General Retail Business District <br />subject to the requirements of such Residence District. <br />(2) Single family cluster dwellings as regulated in Chapter 1136. <br />(3) Retail business. <br />A. The retail sale of baked goods, confectionery, dairy <br />products, delicatessen, fruits, vegetables, groceries, <br />meats and beverages; <br />B. The sale of dry goods and variety merchandise; <br />C. The sale of hardware, household appliances, television <br />and radio, paint, wallpaper, materials and objects for <br />interior decorating; <br />D. The sale of books, magazines, newspapers, tobacco <br />products, drugs, flowers, gifts, music, photographic <br />equipment, sporting goods and stationery; <br />E. The sale of food and beverages of all kinds including <br />sale for consumption on the premises, provided, <br />however, no establishment engaged in the business of <br />selling spirituous, vinous or malt beverages shall be <br />located nearer than 500 feet from the lot occupied by an <br />existing church, public or private school, playground, <br />park, library or public building; <br />F. The retail sale of general rnerchandise including sales <br />in a department store; <br />G. The retail sale of apparel of all kinds; <br />H. The retail sale of furniture, china, floor coverings and <br />household goods; <br />1. Automobile supply stores, automobile showrooms and <br />lots for the sale of new motor vehicles; in addition, <br />show rooms and lots for t:he sale of used cars are <br />permitted accessory uses in this district, provided that <br />such accessory uses shall be located either on a parcel <br />of land upon which is located an existing automobile <br />show room and lot for the sale of new motor vehicles, <br />or upon a parcel of land which is physically contiguous <br />to a parcel of land containing an existing automobile <br />show room and lot for the sale of new motor vehicles; <br />J. The retail sale of motor vehicle fuel provided that no <br />alcoholic beverages are dispensed or sold on the same <br />lot; and
