34.14 CHANGES IN TESTING PROCEDURES <br />The parties recognize that during the life of this Agreement, there may be improvements <br />in the technology of testing procedures which provide more accurate testing. In that event, the <br />parties will bargain in good faith whether to amend this procedure to include such improvements. <br />If the parties are unable to agree in the amendment, they will be submitted to impasse procedures <br />as outlined in Step 4 of the Grievance Procedure of the Collective Bargaining Agreement. <br />34.15 CONFLICT WITH OTHER LAWS <br />This Article is in no way intended to supersede or waive any constitutional or other rights <br />that the employee may be entitled to under Federal, State or local statutes. <br />ARTICLE XXXV PROBATIONARY PERIOD <br />35.1 All new employees shall have a probationary period of eighteen (18) months. <br />Probationary period will be extended until new employee has earned Paramedic Certification or <br />thirty-six (36) months, whichever comes first. <br />During the probationary period, discipline, suspension or discharge by the Employer, <br />shall not be subject to the Grievance Procedure. <br />If an employee is discharged or resigns during the prabationary period described in the <br />aforementioned Section of this Article, and is later rehired, he shall be considered as a new <br />employee and subj ect to all terms contained witYiin this Agreement. <br />ARTICLE XXXVI PERSONNEL RECORDS <br />36.1 The Employer shall maintain an individual official personnel file for each employee. The <br />afficial personnel file shall be located in the Department of Human Resources. Employees shall <br />be pertnitted to inspect their individual personnel file during regular business hours (8:00 a.m. - <br />4:00 p.m.; Monday through Friday, excluding Saturdays, Sundays and Holidays) by giving <br />reasonable notice and request to inspect said individual personnel file to the Director of Human <br />Resources. Should the Director of Human Resources not be available at the requested time, he <br />shall schedule a time mutually agreeable between himself and the employee. During the <br />inspection of the official file, the employee may have one (1) representative present. The <br />Employer may have one (1) representative present at the time the official personnel file is being <br />inspected by the employee. <br />36.2 Subject to the provisions of Ohio's public records laws, only the Director of Human <br />Resources, Fire Chief and the employee shall have access to the personnel file, except other City <br />Officials may have access and inspect the personnel file as needed to perform the functions of <br />their office. <br />34 <br />z
