ARTICLE XXXVII LABOR MANAGEMENT COMMITTEE <br />37.1 In the interest of sound Labor/Management relations, unless mutually agreed otherwise, <br />once each quarter on a mutually agreeable day and time, up to three (3) of the Employer's <br />Representatives shall meet with up to three (3) Association Representatives to discuss pending <br />problems or issues of concern and to promote a more harmonious Labor/Management <br />relationship. The Mayor shall be present when his participation is necessary to resolve an agenda <br />item. <br />37.2 An agenda will be furnished upon request of either party at least seven (7) days in <br />advance of the scheduled rneetings with a list of the matters to be taken up in the meeting, and <br />the names of those Association representatives and management representatives who wil] be <br />attending. <br />37.3 It is further agreed that if special Labor/Management meetings have been requested, and <br />mutually agreed upon, they shall be convened as soon as feasible. <br />ARTfCLE x:XXVIII SAFE MINIMUM STAFFING <br />38.1 The City and Unian shall establish a Fire Deparhnent Safe Minimum Staffmg committee <br />to develap an implementation plan on how to raise the daily minimum safe staffing levels of line <br />personnel and will attempt to implement such plan as soon as possible. The Fire Department Safe <br />Minimum Staffing committee shail consist of seven (7) members, 3 representa.tives of IAFF <br />Local 1267, the Fire Chief, Assistant Fire Chief, Finance Director and Safety Director. The Law <br />Director shall act as legal advisor only. Two (2) members of City Council of which preferably <br />one (1) sha11 be from the City Council Safety Committee and one (1) from the Finance <br />Committee shall be invited to participate in said committee as advisors also. The committee shall <br />begin meeting within sixty (60) days following the signing of the collective bargaining <br />agreetnent and meet monthly there after until completion, <br />ARTICLE XXXIX GENDER AND PLURAL <br />39.1 Whenever the context so requires, the use of words herein, in the singular, shall be <br />constnted to include the plural, and words in the plural, the singular, and words whether in the <br />inasculine, feminine or neuter gender shall be construed to include all of said genders. By the <br />use of either the masculine or feminine genders it is understood that said use is for convenience <br />purposes only and is not to be interpreted to be discriminatory by reason of sex. <br />ARTICLE XL DURATION OF AGREEMENT <br />40.1 This Agreement shall be effective as of January l, 2007, and shall remain in full force <br />and effect until December 31, 2008, and it shall automatically be renewed from year to year <br />thereafter, unless either party shall have notified the other in writing in accordance with Article <br />XXXII. <br />35
