, <br />bl? <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2008 - 69 <br />BY: Council Members Mahoney and Barker <br />AN ORDINANCE PROVIDING FOR THE SUBMISSION TO <br />THE ELECTORS OF THE CITY OF NORTH OLMSTED OF <br />AN AMENDMENT TO ARTICLE VI, SECTION 3 OF THE <br />CHARTER OF THE CITY OF NORTH OLMSTED TO <br />PROVIDE FOR THE FIRE CHIEF TO BECOME A MEMBER <br />OF THE UNCLASSIFIED SER VICE OF THE CITY, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, it is the belief of the Administration that the City Fire Department could be <br />more efficiently and cost effectively managed by removing the position of Fire Chief from the <br />classified civil service and granting authority to the Director of Public Safety to select and <br />appoint the Fire Chief through a competitive open interview process rather than closed civil <br />service promotional examination process; and <br />WHEREAS, it is the desire of this Council, acting upon the recommendation of the <br />Administration, to subinit to the voters of North Olmsted a proposal to amend Article VI, Section <br />3 of the Charter to remove the position of Fire Chief from the classified service of the City <br />government to authorize the Director of Public Safety to select and appoint the Fire Chief f3m <br />an open competitive interview process; and <br />WHEREAS, this proposal was referred to the Charter Review Commission for review <br />and recommendation, in accordance with the provisions of Article XIV, Section (b)(2) of the <br />City Charter; and the Charter Review Commission, upon review, issued its report to this Council <br />on the l lth day of June, 2008, recommending approval; and <br />WHEREAS, this Council has adopted this Ordinance, as required by state law, no sooner <br />than 120 days, and no later than 60 days, prior to the date of the election at which the issue will <br />be voted upon by the electorate; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, OHID, TWO-THIRDS OF ALL <br />MEMBERS CONCURRING THAT: <br />SECTION 1. Pursuant to Article XVIII, Sections 9 of the Ohio Constitution, and Article <br />XII of the Charter of the City of North Olmsted, this Counci] authorizes and directs that the <br />following proposal to amend the Charter of the City of North Olmsted be submitted to the
