City as to said storage facilities, and otherwise to the extent that it determines, <br />in its sole discretion, to support and supply food to the EFC. <br />C. The parties' respective charitable and/or public interests are and shall remain <br />independent, not herein entangled or subject to joint enterprise, but cooperate <br />to the extent of their common interest in food storage at and supply for EFC. <br />D. The parties' agree that this cooperation shall continue from month to month as <br />necessary and may be unilaterally terminated without cause or explanation at <br />any time upon 30 days notice. <br />E. The scope of this agreement is limited by and shall be interpreted consistently <br />with the Establishment clause of the First Amendment to the United States <br />Constitution, as applicable to the States, and as the parties arrangement for <br />food storage facilities and distribution are not designed to establish, enable or <br />perpetuate any religion or religious activities but rather to facilitate emergency <br />rations of food supplies to citizens based on need, on a nonsecular basis and <br />without religious prerequisite, qualification or performance. <br />IN WITNESS WHEREOF, the undersigned have executed this Cooperative Agreement <br />as of this day of <br />, 2008 <br />ST.
