, <br />. <br />, . <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2008 - 84 <br />BY: Mayor O'Grady <br />AN ORDINANCE PROVIDING FOR THE SUBMISSION TO THE <br />ELECTORS OF THE CITY OF NORTH OLMSTED OF <br />AMENDMENTS TO ARTICLE III, SECTION S, AND ARTICLE Y, <br />SECTIONS 1, 4, 5, AND 6 OF THE CHARTER OF THE CITY OF <br />NORTH OLMSTED TO GRANT AUTHORITY TO THE MAYOR <br />TO CREATE, ELIMINATE, AND/OR MERGE DEPARTMENTS <br />HEADED BY APPOINTED DIRECTORS; TO FURTHER GRANT <br />TO THE MAYOR THE EXCLUSIYE AUTHORITY TO ASSIGN <br />DUTIES TO THE APPOINTED DIRECTORS; TO FURTHER <br />ABOLISH THE DEPARTMENTS OF PUBLIC SERVICE, PUBLIC <br />SAFETY AND COMMUNITY LIFE SERVICES AS CHARTER- <br />LEVEL DEPARTMENTS; AND DECLARING AN EMERGENCY. <br />WHEREAS, the Mayor believes, and accordingly recommends to this Council, t:hat <br />the administrative operations of the City government would be more effectively and <br />efficiently conducted by conferring additional powers upon the office of the Mayor that would <br />enable him to create new or delete existing appointed director positions in the C±ity <br />government, and to have exclusive authority over the assignment of duties to such directar; <br />and <br />WHEREAS, the Mayor further believes that the Departments of Public Service, Put>lic <br />Safety and Community Life Services should not be charter-level departments, but should be <br />instead created, changed, merged and eliminated, as necessary and appropriate, by mayc?ral <br />policy directive; and <br />WHEREAS, it is the desire of this Council, acting upon the said recommendations of <br />the Mayar, to submit to the voters of North Olmsted a proposal to amend Article III, Section <br />5, and Article V, Sections 1, 4, 5 and 6 of the Charter to confer such additional powers upcil <br />the office of the Mayor and provide for the Departments of Public Service, Public Safety and <br />Community Life Services to be established by mayoral policy rather than by Charter; and <br />WHEREAS, this proposal was referred to the Charter Review Commission for review <br />and recommendation, in accordance with the provisions of Article XIV, Section (b)(2) of the <br />City Charter, and the Charter Review Commission, upon review, issued its report to this <br />Council on the l lth day of June, 2008, not recommending approval; and <br />WHEREAS, this Council has adopted this Ordinance, as required by state law, no <br />sooner than 120 days, and no later than 60 days, prior to the date of the election at which the <br />issue will be voted upon by the electorate;
