Ma!d 20 OB 05:13p p,,4 <br />3.2 Drue-Free Wor lace: The Contractor certifies that to the best of his/her ability, all of his/her <br />employees will not purchase, transfer, use, or possess illegal drugs or alcohol or abuse <br />prescription drugs in any way while working on state property. Failure to comply wiU result in <br />IMMEDIATE termination of this agreement. <br />3_3 EEO Oaoortunitv Reauirements: The Contacior shall comply with the requirements under <br />O.R.C. 125.111. The Contractor shall not discriminate against anyone because of race, coinr, <br />religion, creed, sex, age, disability, national arigin or ancestry. <br />3.4 Dhio Electioo Law: The Contrador affirms that, as applicable to it, no party listed in O.R.C. <br />3517.13 (I) or (J) (including an individual, partner, shareholder, administrdtor, exetutor, trustee <br />or owner of more than twenty percent of the corporation or business trust), nor the spouse af <br />such party, has made, as an individual, within the two previous calendar years, one of more <br />contributions totaling in excess of on thousand dol{ars ($1,000.00) to the Governor or ta the <br />Governors campaign committee, consistent with the restrictions under O.R.C. 3517.13 (1) and <br />W • <br />The Contract Documents embody the entire understanding of the parties and frorn the basis of the <br />Contract between the Department and the ContractDr. The Contract Documents shall be considered to <br />be incorporated by reference into this Contract as if fully rewritten herein. <br />The Contract and any modification, amendments or alterations thereto sha{l be governed, construed <br />and enforced by and under the iaws of the State of Ohio. <br />tf any term or provision of the Contract, or the application thereof to any person or circumstance, is <br />finaliy determined, to be invalid or unentarceable by a court of compeient jurisdiction, the remainder of <br />the Contract or the application of such term or provision to other persons or circumstances, shall not be <br />affected ihereby, and each term and provision of the Contact shall be valid and enforced to tF?e fullest <br />extent permitted by iaw. <br />The Contract shall be binding on the Contr-actor and the City of North 0lmstead, their suaessors and <br />assigns, in respect to all covenants and obtigations contained in the Contract Documents, but the <br />Contract rnay not be assigned by the Contractor without prior written consent of the City of North <br />Olmstead. <br />i"his Contract has been executed in several counterparts, each of which shall constitute a complete <br />original Contract which may be introduced in evidence or used for any other pwpose without <br />production of any other counterparts.
