. <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2008 - 9 <br />BY: Mayor O'Grady <br />AN ORDINANCE DISPENSING WITH A FORMAL RFP PROCESS AND <br />A UTHORIZING THE MA YOR TO ENTER INTO A CONTRACT WITH <br />ATS ENGINEERING, INC. TO PROVIDE ENGINEERING DESIGNAND <br />OTHER RELATED PROFESSIONAL SERVICES TO THE CITY OF <br />NORTH OLMSTED IN CONNECTION WITH PROPOSED <br />IMPROVEMENTS TO THE WASTEWATER TREATMENT PLANT AND <br />COLLECTIONS SYSTEM, AND DECLARING AN EMERGENCY. <br />WHEREAS, this Council on November 15, 2005, adopted Ordinance No. 2005-167 <br />authorizing the Director of Public Service to request proposals from qualifying consulting <br />engineer firms to conduct a rate and operations study of the North Olmsted Wastewater <br />Treatment Plant and Collections System; and <br />WHEREAS, proposals were thereafter submitted by various consulting engineering <br />firms and, on July 25, 2006, the City's Board of Control awarded a contract to ATS <br />Engineering, Inc., as the firm most qualified to conduct the rate and operations study for the <br />City; and <br />WHEREAS, in the years 2006-2007, ATS Engineering, Inc. comprehensively studied <br />and reviewed the rate structure and operations of the Wastewater Treatment Plant and <br />Collections System, and, on September 12, 2007, presented to this City Council its formal <br />report which recommended an increase in user charges, plant operational changes, and <br />various improvements to the Wastewater Treatment Plant and Collections System; and <br />WHEREAS, based on the recommendations of the Administration and ATS <br />Engineering, Inc., this Council, on November 20, 2007, adopted Ordinance No. 2007-123, <br />which provided for an increase in user charges effective January 1, 2008; and <br />WHEREAS, the City now requires additional consulting engineer firm services in <br />order to provide engineering design and other related professional services to the City in <br />connection with the above referenced proposed improvements to the Wastewater Treatment <br />Plant and Collections System; and <br />WHEREAS, Section 111.08 of the Administrative Code provides that personal <br />services, including professional services, may be obtained by the City without following the <br />formal RFP process established by Section 111.03 et seq. of the Administrative Code, when it <br />is beneficial to do so due to a continuing relationship between the City and a professional <br />services provider; and <br />WHEREAS, it is accordingly the recommendation of the Director of Public Service <br />and the desire of this Council, in light of the continuing professional relationship between the <br />City and ATS Engineering, Inc., to dispense with the RFP process and authorize the Mayor to <br />enter into a contract with ATS Engineering, Inc., for the purpose of providing the engineering <br />design and other related professional services needed for the proposed improvements to the <br />Wastewater Treatment Plant and Collections System; <br />, ._ <br />?..,,
