Ordinance No. 2008-9 <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the formal RFP process required by Sections 111.03 et seq. of the <br />Administrative Code is hereby dispensed with by reason of the continuing professional <br />relationship between the City and ATS Engineering, Inc., and the Mayor be and he hereby is <br />authorized to enter into a contract with ATS Engineering, Inc., to provide engineering design <br />and other related professional services for the proposed improvements to the North Olmsted <br />Wastewater Treatment Plant and Collections System. <br />SECTION 2: That said contract shall be in a final form and substance substantially <br />the same as the Professional Services Agreement attached to this Ordinance as "Bxhibit A," to <br />which is attached the proposal of ATS Engineering, Inc., dated January 14, 2008, with only <br />such changes thereto in the form and substance of the Agreement and Proposal that are not <br />substantially adverse to the City. The character of any such changes as not being substantially <br />adverse to the City shall be evidenced conclusively by the execution of the Agreement by the <br />Mayor and the approval of the Agreement by the Director of Law. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for <br />the reason that this legislation must go into effect immediately in order to address I/I problems <br />in the Collections System as quickly as possible and to adhere to timelines set far the City by <br />the Ohio EPA; and further provided it receives the affirmative vote of two-thirds of all <br />members of Council, it shall take effect and be in force immediately upon its passage and <br />approval by the Mayor. <br />, <br />PASSED: ? /s-4 <br />A TTEST.• <br />First Reading: <br />Second Reading: <br />Third Reading: -T5" c; ? <br />Committee: 4 <br />? <br />BARBARA L.
