17.4 Any employee under indictment or arrested for a felony shall be placed on leave <br />of absence without pay until resolution of the court proceedings. An employee may use accrued <br />vacation, holiday, or personal time during the leave. An employee found guilty by the trial court <br />may be discharged. An employee found innocent of the chazges shall be paid for all lost time and <br />shalI have any vacation, holiday, or personal time restored to his credit. In addition, all expected <br />cost or premium cost of hospitalization benefits paid by such employee shall be reimbursed less <br />amount of employee co-payment required per Article 12. The Employer sha11, during the period <br />for which the employee is utilizing vacation, holidays or personal time, continue to pay the <br />employee's insurance premiums during the leave of absence. <br />Upon exhausting vacation, Holidays and Personal time, said employee will be required to <br />pay the Director of Finance (100%) of a11 expected cost or premium cost for the purpose of <br />continuing hospitalization benefits during the balance of the leave of absence. <br />ARTICLE 18 <br />LEGALITY <br />18.1 It is the intent of the City and the F.O.P. that this Agreement comply in every <br />respect with applicable legal statutas and charter requirements. If it is determined that any <br />provisions of this Agreement are in conflict with any court of competent jurisdiction, that <br />provision sha11 be null and void and shall not a.fFect the valid.ity of the remaining pazagraphs of <br />this Agreement. <br />18.2 Any past understanding, ordinance or resolution which has been in effect shall <br />remain in effect until such time that it is modified by a subsequent agreement. Such modification <br />shall be completed by the procedures set up in this Agreement for negotiations. <br />2s <br />
