Onc gcnerat <br />reyuirement is to develop a Plan of Uperution and Ciovernunce (the I'lan) for the Aggregatian <br />Program. The Plan is subject to revicw by citizens in communitizs undertakina government <br />aggrcgation, and is also subjeet to approval and certification by the Public Utilities Commission <br />of C?hio. The Plan describss the Aggregation Program to be utilized for participating consumers <br />in NOPEC cornmunities. <br />1.2 Description of the Aggregatian Program <br />The Aagregation I'rogram involvcs the acquisition of cornpetitivc retail power supply. <br />Distributivn services (metering, billing, maintenauce of the transmission and distrihut+on system) <br />will continue as the functian of the lacal distribution company. The local distribution company <br />shall also be the "provider of last resort" far consumers not participating in the Aggregatian <br />Program who have no otha competitive supplier. Tbe NOPEC Aggregation Prograrn has been <br />undertaken as an "apt-out" progzam that requires authorization of cnmmunities and their <br />constitucnts in a public process. All eligible cansumers will be included in the Aggregation <br />Program unless they choose to `.`opt-out" as described in section 2.4.1 of this Plan. <br />The Aggregation Pro$ram has becn undertaken at two levols. At the local Icvei, <br />communities wishing to be government aggregators have authorir.ed the opt•out Aggregation <br />Program in a public process as rec}uired by law and ouElined below in sectior 1.3. At the regional <br />level, commuriities wishing to proceed jointly with an Aggregatian Program have formed <br />NC)PEC undcr Chapter 167 of the Oliio Rtvised Code, which the communities have auihorized <br />to perform as their agcnt for developmcnt and implementation of the Aggregation Program as <br />outlined in se;ctions 1.3 and I.A. The opecations of the Aggregation Pragram are described in <br />section 2 of the Plan, and the govemance of the program is descAbed in section 3. <br />1.3 Steps Required by the Law <br />1'he process of establishing gavemment aggregation invoives a multi-step public process <br />undertaken by the metnber communitics or jointly tluvugh NOPEC an their behalf• <br />1.1.3 I.ocal legislative body passes ordinance or resolution authorizing aggregation program for <br />consumers (the indicating option for prior consent "opt-in", oc option for automatic <br />en.roilment and opt-out opportunity); <br />1.3.2 Ordinance vr resolution (if an autamatic enrollmenE and opt-aut is to be used) is <br />submittcd to the lacal Boazd of Elections ttot less than 75 days before the day of special <br />election on the next primary or generat clection; <br />1.1.3 Ordinance or resolution authorizing apt-out is placed bcforc voters at special election, or <br />in a referendum petition; approval of a majocity of voters voting on the ordinance or <br />resolution is reyuired; er if by petition, signatures of nat less than tcn percent of the total <br />number af elcctars in the respcctive community who vvted for the offiee of Governnr in <br />the prcceding general election; <br />1.3.4 Dcvefop a Plan of Operation snd Govcrnance and submit Plan to PUCO for cectification; <br />4 <br />P.OII. <br />? ?.:?... <br />' . •. *;-?. ?na.. .., 4
