<br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2000-161 <br />BY: COUNCII.MAN GAREAU <br />AN ORDINANCE CREATING NEW SECTION 165.16 OF CHAPTER 165 OF THE <br />ADMINISTRATIVE CODE OF THE CITY OF NORTH OLMSTED, ENTITLED <br />"PROCEDURE FOR MINOR CHANGES," IN ORDER TO ESTABLISH AN <br />EXPEDITE,D APPROVAL PROCEDURE FOR MINOR CHANGES TO HISTORICAL <br />STRUCTURES AND OTHER STRUCTURES LOCATED IN HISTORICAL <br />DISTRICTS, AND DECLARING AN EMERGENCY, AS AMENDED. <br />WHEREAS, on May 5, 1999, tius Council adopted Ordinance No. 99-40, which created a <br />comprehensive process for reviewing building and demolition permits involving historical structures <br />and non-historical structures located in lustorical districts of the City; and <br />WHE.REAS, during the past several year, in the course of administering the process <br />established by Ordinance No. 9940, the Landmarks Commission has been required to hold hearings <br />on building permit applications which ha.ve involved minor matters which did not lave any significarn <br />impact on the historical structures or historical districts involved; and <br />WHEREAS, it is the desire of this Council, in order to improve and streamline the <br />administrative process created by Ordinance No. 99-40, to create and provide for a minor change <br />procedure wlpch would authorize the Landmarks Commission to dispense with review of applications <br />for building pernut applications which only involve minor changes to historical structures, or to non- <br />historical structures located in historical districts; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH 4LMSTED, COIINTY OF CiIYAHOGA AND STATE OF OHIO: <br />SECTION 1: That there be and is hereby crea.ted new Section 165.16 of Chapter 165 of the <br />North Olmsted Codified Ordinances, entitled "Procedure for Muior Changes," which, as created, sha11 <br />read in its entirety as follows: <br />165.16 PROCEDURE FOR "MINOR CHANGES." <br />(a) Definition. "Muior change" sha11 mean and refer to any proposed alteration, rehabilitation, <br />restoration, construction or other improvement of any designated Landmark or any other building <br />loca.ted within the Landmarks District which would, but for the Minor Change procedure herein, <br />be subject to full and formal hearing requirements to obtain a Certificate of Appropriateness, and <br />which proposal may be expedited for review by the Landmarks Commission due to its consistency <br />with the overall public purpose of this Chapter and, upon the opinion of the Building Official, that <br />the proposal is limited in scope and in scale relative to the design criteria and guidelines herein, <br />or in the opinion of the Building Official, the proposal is of sufficient urgency to be considered <br />for expedited review herein. Minor changes sha11 include, but are not limited to, the following: <br />(1) The installation of driveways, sidewalks, walkways or other similar land <br />surface improvements, so long as the original configurations is not changed; <br />(2) Patios and decks located in the rear yard and do not involve any changes to the <br />landmark structure itself, or to the main building on property located in a landmark <br />district; <br />? <br />..?«ur
