SECTION 1: That there be and is hereby created new Section 165.16 of Chapter 165 of the <br />North Olmsted Codified Ordinances, entitled "Procedure for Minor Changes," which, as created, shall <br />read in its entirety as follows: <br />165.16 PROCEDURE FOR "MINOR CHANGES." <br />(a) Definition. "Minor change" means: <br />(1) To any landmark, or any other building, structure or improvement located <br />in a landmark district, the installation of, replacement of or repair to any <br />of the following: <br />(A) Driveways, sidewalks, walkways, or other similar land surface <br />improvements, so long as the original configuration is not changed and <br />the materials used are of like and similar quality, texture and color to the <br />original materials used; <br />(B) Patios and decks, so long as they are not visible from the street and <br />do not involve any changes to the landmark itself, or to the main building <br />on property located in a landmark district; <br />(C) Roofs, so long as the materials used are of like and similar quality, <br />texture and color, and the existing architectural style of the roof is not <br />changed as a result; <br />(D) Fences, so long as the fence is not visible from the street; and <br />(E) Windows, doors and siding, so long as the materials used are of like <br />and similar quality, texture, and color, to the original materials used, and <br />the size or shape of the windows, doors or siding is not changed as a <br />result. <br />(2) Painting of any landmark in colors and finishes which are appropriate with <br />respect to the historic period of the structure and illustrate the distinctive <br />character of the property; and painting of any other building or structure <br />located in a landmark district, so long as the painting is not of a color or <br />finish which will likely have a negative aesthetic impact on landmarks <br />located within view of the building or structure painted. <br />(b) Procedure. Application for building permits for proposed minor changes shall <br />be reviewed by the Building Official and not submitted to the L,andmazks Commission for its <br />review pursuant Sections 165.08 and 165.09 of this Chapter; provided, however, that the Building <br />Official shall, upon receiving and reviewing such an application, give written notice to all <br />members of the Landmarks Commission If a majority of the members of the Landmarks <br />Commission, within seven days of receipt of notice from the Building Official, advises the <br />Building Official in writing that the proposal should be reviewed by the Commission pursuant to <br />the provisions of either Section 165.08 or 165.09, then the Building Official shall refer the <br />proposal to the Landmarks Commission for full review in accordance with the applicable <br />procedures set forth in this Chapter. <br />SECTION 2: That the operation of any Ordinance, or part of any Ordinance in conflict <br />or inconsistent with any provision of this Ordinance is, to the extent of any such conflict or <br />inconsistency, repealed. <br />SECTION 3: That this legislation is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />further reason that it is immediately necessary to provide for a minor change process in <br />2 <br />
