CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2000-133 <br />BY: MAYOR MUSIAL AND THE ENTIRE COUNCIL <br />AN ORDINANCE AUTHORIZING THE CITY OF NORTH <br />OLMSTED TO ENTER INTO THE NORTHEAST OHIO <br />PUBLIC ENERGY COUNCIL OF GO E + NTS AND 1'HE <br />EXECUTION AND DELIVERY OF THE AGREEMENT <br />ESTABLISBING SUCH COUNCIL, FOR THE PURPOSE OF <br />JOINTLY ESTABLISHING AND IlVIPLEMENTING AN <br />ELECTRICITY AGGREGATION PROGRAM, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, this Council previously enacted legislation authorizing the City to establish <br />an electricity aggregation program pursuant to Section 4928.20, Ohio Revised Code (the <br />"Electricity Aggregation Program"), for the residents, businesses and other electric consumers <br />in the City, and for that purpose, to act jointly with any other municipal corporation, township, <br />county, or other political subdivision of the State of Ohio, as permitted by law; and <br />WHEREAS, by joining the Northeast Ohio Public Energy Council, the City will be able <br />to act jointly with other political subdivisions that have authorized the Electricity Aggregation <br />Program in their respective jurisdictions and thereby maximize the potential benefits of electricity <br />deregulation through group purchasing efforts; and <br />WHEREAS, it is the desire of this Council to authorize the City to join the Northeast <br />Ohio Public Energy Council of Governments if the ballot issue authorized by Ordinance No. <br />2000-78 is passed by the voters of the City of North Olmsted; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />Section 1: That this Council finds and determines that it is in the best interest of the City <br />including its residents, businesses and governmental entities, to join the Northeast Ohio Public <br />Energy Council for the purpose of establishing and implementing the Aggregation Program in the <br />City, all as authorized under Ordinance No. 2000-78, authorizing the Aggregation Program <br />previously adopted by this Council. <br />Section 2: That the Mayor is hereby authorized to execute and deliver the Agreement <br />establishing the Northeast Ohio Public Energy Council (the "Agreement"), provided that the ballot <br />1 <br />... . .. . . . . . . . .. .. . . . .. . .. . . .. .. . . .... . .. ... . _ , .,.,.,. .,-..:?„?.x?,... ?srf? .. . 3?Tar.
