of full-time "hostler"; the start of the day shift shall not be later than 12:00 noon. The start of the <br />night shift shall not be later than 5:00 p.m. <br />Section 13.05 A part-time worker is not to work more than thirty (30) hours, per-week. If a <br />situation arises where a part-time employee will exceed this limitation, the NOMBL shall notify a <br />union representative to address this issue. <br />ARTICLE 14 <br />SENIORITY AND LAYOFF <br />Section 14.01 Seniority shall be determined by continuous service with the Transit <br />Department. Only non-probationary full-time employees shall haye seniority. No employee shall <br />have seniority during the probationary period provided in Article 12 but, seniority shall be retroactive <br />to the date of hire; once the employee satisfactorily completes the probationary period. Continuous <br />service shall only be broken by retirement, resignation or discharge. One seniority list shall be <br />maintained for full-time employees. The seniority of an individual shall not accrue for those days <br />not worked when an employee is in a"no pay" status (e.g. off on sick leave without pay, off on a <br />leave of absence without pay, off due to a disciplinary suspension) any of which exceeds the greater <br />of ten (10) days or eighty (80) hours in a calender year. All time in excess of ten (10) days or eighty <br />(80) hours in a calender year shall not count toward the accrual of seniority. Provided, however, an <br />employee in "no pay" status and off without the use of sick leave due to a work related injury or <br />occupational disease shall continue to accrue seniority for a period not to exceed one year. <br />Accordingly, if an employee is not accraing seniority and a less senior employee is accruing <br />seniority, the less senior employee could accrue sufficient seniority to equal or surpass in seniority the <br />employee whose seniority is not accruing. <br />Section 14.02 Seniority within the Transit Department shall govern for all purposes, except <br />for the scheduling of runs for operators only, which shall be governed on the basis of seniority <br />within the operator's classification. The operators having the most seniority, during a run pick, <br />shall have the first choice of runs and so on down the Iist until all runs are filled. Any runs or <br />assignments which are not picked for any particular day shall be assigned ta the f rst extra <br />operator for that day from the bottom of the seniority list. <br />Section 14.03 Where because of economy, consolidation or otherwise, the employer <br />determines it necessary to reduce the size of its work force, such reduction shall not be made <br />without notifying AFSCME Ohio Council 8, and AFSCME Local 3517, NOMBL. <br />Section 14.04 Whenever the employer deems it necessary to reduce the number of employees <br />within any classification with the Transit Department the least senior full-time employee within <br />that classification covered by this agreement shall be laid off first. When the seniority of two or more <br />employees is equal, employees shall be laid off by the drawing of Iots. In the event of a <br />layoff, the affected employees shall receive payment of any unused vacation as quickly as <br />practicable but no later than fourteen (14) calender days following the date of layoff. <br />Section 14.05 A. Should a position with the Transit Department be re-created or re-established the <br />most senior employee on lay off status shall be recalled to fill the position providing management <br />believes that the employee on layoff status has the skills necessary, knowledge and the ability <br />to perform the duties af the position. Should the employer recall a laid off employee and the <br />employee fails to satisfactorily demonstrate the skills necessary, the knowledge and ability to <br />
