00, Section 18.15 Any abuse of sick leave or the patterned use of sick leave shall be just and <br />4w sufficient cause for discipline, including discharge, as may be determined by the Employer. <br />(Example: Mondays, Fridays, day after payday, etc.) <br />Section 18.16 Any employee scheduled to work on a holiday who reports sick shall be charged <br />sick leave for that holiday, provided the proper NOMBL medical form has been completed and <br />shall forfeit his right to receive the holiday pay. If the employee has no sick leave or does not <br />have the proper NOMBL medical form completed, he shall receive no pay for that day. <br />ARTICLE 19 <br />LEAVES OF ABSENCE & FUNERAL LEAVES <br />Section 19.01 All employees shall be entitled to take a personal leave of absence with the <br />approval of the Service Director and under the terms and conditions as he sets forth, which <br />approval shall not be unreasonably withheld. Any leave of absence for personal reasons, shall not, <br />however, exceed a ninety (90) day period. Said employee in order to maintain any and all benefits <br />which are paid by the City shall be required to pay the Finance Director, the cost of said benefits <br />in advance on a monthly basis. The maximum permissible leave of absence for any reason shall <br />be ninety (90) days. The written request to the Service Director must clearly explain the reason for <br />the personal leave of absence and be specific as to the dates required. <br />(a) Special circumstances may occur for an employee to make application to the <br />Service Director for a leave of absence; whereby this leave will not affect the <br />employee's seniority as stated in Section 14.01. This situation will not be <br />precedent setting for past or future leave of absence requests granted by the city. <br />Section 19.02 Any employee who is required to be away from work due to sickness shall be <br />entitled to use up sick leave which has been accumulated, according to the rates as specified in <br />Sec. 18.05, and Sec. 18.06. When an employee has exhausted all accumulated sick leave, then that <br />employee shall be entitled to a sickness leave of absence which shall not exceed ninety (90) days <br />from the date that said employee has exhausted his accumulated sick leave. During said ninety (90) <br />day period, said employee, in order to maintain any and all benefits which are paid by the City shall <br />be required to pay the Finance Director, the cost of said benefits in advance on a monthly basis. <br />Section 19.03 After the leave of absence specified in Section 19.01 and 19.02 has terminated, <br />the employee shall report to the General Manager for work. If the employee fails to do so, the <br />employee shall be terminated. This section shall not affect the application of Worker's Compensation <br />statute. Section 19.04 A full-time employee shall be granted time off with pay (not to be deducted <br />from the employee's sick leave) for the purpose of attending the funeral of a member of the <br />employee's family. Each full-time employee shall be entitled to three (3) work days off, if <br />necessary, for attending local funeral services of inembers of his immediate family, or up to five <br />(5) wark days off, if necessary, for the out-of-state funeral of a member of the immediate family. <br />Immediate family, for purposes of this section is defined as spouse, son, daughter, brother, sister, <br />parent or grandparent, father-in-law, mother-in-law, son-in-law, daughter-in-law, step-father, <br />step-mother, step-sister, step-brother, step-son, and stepdaughter. The Employer reserves the <br />right to request proof or certification from the employee prior to payment of the days off as <br />described in this section. <br />16 <br />
