f. Employees in the appointed position of Dispatcher/Driver shall perform all Dispatcher <br />responsibilities as determined by the Employer. <br />g. Employees in the appointed position of Dispatcher/Driver may be required by the Employer <br />to act as training instructors for new bus operators, retrain current operators or to perform <br />other functions of a training/class nature. When required and assigned to function as a <br />training instructor, a Dispatcher/Driver shall be paid an additional $.40 cents per-hour <br />additional to his hourly rate as delineated in (e) above, for each hour he actually performs <br />work as a training instructor. The Employer reserves the right to not assign a <br />Dispatcher/Driver as a training instructor and retains it's option to use other operators, <br />management or another agency for training purposes. Both parties recognize and agree that <br />the Federal Transit Administration, the GCRTA or another agency, may establish and dictate <br />future training methods, certifications, ]ocations, etc. that the employer would have no control <br />over. <br />Section 34.05 Night Shift Premium-Maintenance Employees <br />Effective August l, 1997: The employer shall pay a forty(.40) cents per hour night shift <br />premium. The night shift premium shall be paid to all full-time maintenance staff that are scheduled <br />and work a night shift. Both parties agree that the current night shift hours, on two shifts established <br />by the Employer, fall approximately between 5:00 p.m. and 7:30 a.m. However, the Employer retains <br />the right to eliminate and/or change night shift hours and schedules as operational need and <br />conditions require. If a night shift maintenance employee is asked to work overtime immediately <br />following the completion of his scheduled night hours, he shall be paid at a time & one-half rate <br />based upon his regular hourly rate without a night shift differential for all overtime work performed. <br />Section 34.06: Whenever a Lead maintenance employee is out 8 hours or more and is replaced by a <br />maintenance employee and performs lead duties, the employee shall be paid at the higher of his/her <br />rate own rate of pay or the missing employee's rate of pay within the same rate step. <br />ARTICLE 35 <br />CONFORMITY TO LAW <br />If the enactment of legislation, or a determination by a court of final and competent <br />jurisdiction (whether in the preceding between the parties or in one not between the parties) <br />renders any portion of this Agreement invalid or unenforceable, such legislation or decision shall <br />not affect the validity of the surviving portions of this Agreement, which shall remain in full force <br />and effect as if such invalid portion thereof had not been included herein. The parties shall begin <br />negotiating with respect to any provision or provisions of this Agreement determined to be <br />invalid or in violation of law, as specified herein, within thirty (30) days of such determination. <br />ARTICLE 36 <br />TERM OF AGREEMENT <br />The term of this Agreement shall be from August 1, 2000 to July 31, 2003 , and it shall <br />continue from year to year beyond the original term hereof unless either party notified the <br />other in writing, not later than sixty (60) days prior to the initial expiration date or the <br />expiration date in subsequent years, of its desire to modify or amend this Agreement. <br />30 <br />
